Abusive additional card holder

in Credit cards
About 2 years ago I made the mistake of giving someone else access to my store card. He set up a diret debit to make the payments and to make matters easier and as a matter of trust i allowed all statements to be sent to his address.
Problem is he didn't pay up and last month I came within an inch of a CCJ and as I plan to have an actual future including a mortgage and own business released I must pay this so I made a full payment.
Naturally I want his name removed from the account but I cant as G E Capital bank are refusing to confirm if I have an account with them or not!!!! They insist I talk to the solicitors who are all very nice be it a bit patronizing but are unable to help as they to not have access to thee databases.
All I want to do is protect myself is there a way can force them into telling me the details of my account as I feel I have a right to know.

how did they come to refuse... on the phone or have you writtten?
In any event under the data protection act you can make a subject access request (SAR) which means they must by law provide all information held about you... maybe phone again0 -
Don't quite understand how there can be any question of you having an account with them if you have just paid the arrears on it. Doesn't the paper work you received asking for payment contain the account details?
Anyway as Clapton said you can make a SAR under the Data Protection Act. Ask for your account details and copies of the agreement you signed.
Address and telephone number to send this to here:-

Hiya kezflake,
good advice so far, but i would like to ask do you have a credit report file ? either from the past or recent one as you store card info should be on there,
alarm bells are ringing here for me for you do not want to scare you in any way but since you have paid the amount off, until you actually take that person off, they can still spend on the card, thus i big priorty to find the info or call the storecard again and insist they locate you or could you stop the card by calling them and say you suspect fraud thus at least no further spending can happen on the card in your name ????
im just worried i know the sar would be good, but id be inclined to stop the card asap because of the further worries incase further spending is made on it.
i would actually make a complaint firstly by phoning ge capital regarding this - they should be able to at least locate you and put a stop to any further spending on the account at least until you locate the card number via sars or credit file.
i hope i havent said anything improper but i just wanted to ensure you protected your identity and your money.
Ciao for now hope you get it sorted asap

Does this mean that if you have an additional card holder with a credit balance, you will need to pay that off before you can remove the additional card holder?0
-
I have paid the balance in full and yes I agree that I dont understand that they are saying they no longer handle my account when they are clearly still sending me statements all be it ones without any balance to pay.
I have been told this all over the phone and told to pay by the crediter to contact the soliciter to advise me to contact the creditor.
Thank you for the data protection info I think this will defiantly come in useful.0 -
If you're the primary card holder you can just have the additional card holder removed from the account.0
-
This may be an issue, as most cards will send confirmation to registered address and the additional card holder will know what you are up to and could very well be telling GE to do something else.i allowed all statements to be sent to his address.
I do not understand the involvement of a solicitor. This is not normal. Is there something you have not told us? Did you tell GE about your strange flakey transfer of the account to the additional card holder?"A nation's greatness is measured by how it treats its weakest members." ~ Mahatma Gandhi

I would expect this to follow the same basic set of procedures for when couples divorce. Divorce is not unusual and often acrimonious.
You ought to be able to freeze this account (and others that are shared) immediatly (with a call to the card issuer) but still be jointly liable for debts accrued so far. You have a civil case in law against your previous friend/partner for his share of the debt.
You can apply for a card in your own name should you still wish access to a line of credit.I wonder why it is, that young men are always cautioned against bad girls. Anyone can handle a bad girl. It's the good girls men should be warned against.-David Niven0 -

I am not sure that this is the case.
With Credit Cards, there is no such thing of a joint account. The Primary Card Holder is solely liable for any debts accrued even if they were unaware of the activities of the Secondary Card Holder.
I think a civil case against the friend\partner is on very dodgy ground.0
