You could try sending the this letter;
RIGHT OF APPROPRIATION
Dear Sir/Madam,
ACCOUNT NUMBER: xxxxxxxxx
I am writing to inform you that I am due to have a Tax Credit payment of £xxx paid into my account on xx/xx/xx, and I wish to use my first right of appropriation for this money, for the following purposes;
Rent £xx
Utilities bills £xx
Housekeeping money £xx
I will withdraw the money on the day that it is deposited for the above use, and I would be grateful if you would ensure that any other payments out of my account do not interfere with this withdrawal.

Tecnically though all bank accounts & financial matters become property of the Official receiver at the time the bankruptcy order is signed by the judge in court....so sending a letter without the OR's consent would be pointless not to mention the problems it could cause if the OR found outWe all die. Whilest i agree that going over the OR's head isnt a good idea, if you have no food to live then you dont really have any other choice.
If the acount is the OR's then that is fair enough, but when looking at bank charges, it had been settled that the bank has no right to take your state governed benefits that you need to live on away from you - are we now saying that bankcrupts dont have that right?
Personally if it was me, I would hope that the OR will advise quickly becuase from what has been said it implies that even if the account is not frozen by thursday, it is still property of the OR so withdrawing money from it is in effect stealing from the OR.Bankruptcy Supporters Club No.1790 -
You give up the rights to access of all bank accounts when the BR order is signed by the judge.....if you try to access any bank acc after the BR date then your looking at a possible BRO/BRU from the OR for not co-operating with them....I was lucky I attempted to take cash 1 day after my Br back in march last year..i thought the OR wouldnt find out....he did.....luckily all I received was a severe warning thankfully..We all die. Yes that is correct, and that is why the OR will often have a quick conversation either on the day of BR or the following day to ascertain which bank account is used for living expenses in order that they can tell the bank they have no interest in it. If the OR hasn't called you, you can phone them and ask permission to withdraw from the account, which will usually be fine.Accept your past without regret, handle your present with confidence and face your future without fear0 -

OMG, and the goverment hasnt done anything about this? Is it just me that thinks it is completely wrong? Giving anyone the right to take a persons benifits is just wrong. What if you get stuck with an awkward OR that doesnt want to help?
