I think you're starting to understand my point Stapeley. I've received a Notice not from the card company but straight from the DCA claiming assignment and that I should now send payments to them. I think you'll agree that is dodgy.

Hi, If a DCA are working for the Original Owner of a debt ,it is Not them that will take you to court . They will not risk their own money to chase a debt in the court . If goes back to the OC who then appoint solicitors . They may say they will accept a lower settlement figure , BUT IT HAS TO BE APPROVED BY THE OC .IT IS THE OC THAT YOU MUST HAVE COMFORMATION FROM .

You MUST gain a notice of ASSIGNMENT from the OC to confirm the status of the DCA , have they purchased the debt ? Or working on commission.
After 7 months of to ing and fro ing , I maintained the copy of the application form I was sent is ILLEGABLE . The DCA sent two LETTERS BEFORE ACTION demands . TODAY I received a letter saying no further action is to be taken by them and they have returned the account to the OC .
Shamelessly bumping this important thread .

When i was first contacted by DCA , I foolishly believed what they said .To my cost I rang them and got bullied into making payments to them which I could not afford . Once they had my number (mobile) they kept pestering me to pay more . It was after this harassment that I found this site . That was in November 2007 , since then I have not paid a penny to them . This is due to no enforceable CCA .

I've done some investigating on notices of assignment and found out that if the OC doesn't inform you that they're sending it out to a DCA then that's a breach of OFT guidelines. So I won't be taking any positive action to confirm as suggested Stapes.

Thought I'd post this definitely not as a dig to you but it appears that if you get a notice from a DCA and the OC can't be bothered to tell you then you have another reason to tell them to sod off!

Yes but if the OC sent one , and have a copy , but you did not receive it. I just think it best to confirm it . May be a bit late IF a DCA do take you to court .

It does seem that more and more DCA are returning accounts to OC. Are they getting fed up with the hassle ???

Haven't noticed it any more than usual?

They are always out for the quick profit, so will often pass back or sell on accounts that look like they will be more "hassle" than they are worth.
