What EVERYONE Should Know About DCA!

It does seem that more and more DCA are returning accounts to OC. Are they getting fed up with the hassle ???
Unfortunately, Stapeley, I somehow doubt that that is, indeed, the case.
What we need to remember is that this forum only represents a tiny, miniscule even, percentage of the total 'alleged debtors' in the country, whereas DCAs are targetting a huge portion of the population.
They, the DCAs, are, in the majority of cases, well aware that they either don't have, nor are able to get, a true copy of the executed cca, but they ALSO know that the percentage of 'alleged debtors' that they target, who will be aware of their rights, whether pertaining to the Consumer Credit Act, 1974, the Limitation Act, 1980 or the Data Protection Act, will be minute or even non-existent.
Therefore, when an alleged debtor 'bites back' by using the rights that the various Laws afford that debtor, it is, often, cheaper, and certainly less 'hassle' for the dca to 'walk away' from a potential 'problem' and to concentrate his efforts on the other 99+% of 'alleged debts' where the 'debtor' is unaware of his rights and will, usually, just pay up to get the dca off of their backs - whether the 'debt' is enforceable or not, or even genuine or not. The average dca is a 'lazy b*st**d' and will, inevitably, go for the line of least resistance in his quest for easy money.
That does not make their tactics any more pallatable, nor does it suggest that requesting a cca is, in any way, an easy ticket to 'debt avoidance'.
What it does, however, suggest is that we should be even more vigilant, when questioning the tactics of a dca. We should, wherever applicable, continue to request a true copy of the executed cca, if only to establish whether or not the 'debt' is genuine or enforceable and to establish the right of any dca to pursue that 'debt'.
And we should continue to publicise those DCAs who continue to ignore their legal obligations when demanding money from people when those people may not even be liable for the 'debts' concerned.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.
