What EVERYONE Should Know About DCA!

Hi, If a DCA are working for the Original Owner of a debt ,it is Not them that will take you to court . They will not risk their own money to chase a debt in the court . If goes back to the OC who then appoint solicitors . They may say they will accept a lower settlement figure , BUT IT HAS TO BE APPROVED BY THE OC .IT IS THE OC THAT YOU MUST HAVE COMFORMATION FROM .

You MUST gain a notice of ASSIGNMENT from the OC to confirm the status of the DCA , have they purchased the debt ? Or working on commission.
After 7 months of to ing and fro ing , I maintained the copy of the application form I was sent is ILLEGABLE . The DCA sent two LETTERS BEFORE ACTION demands . TODAY I received a letter saying no further action is to be taken by them and they have returned the account to the OC .

    When and If I hear from the OC . I will send a copy of the 12+2+30 day letter I sent the DCA six months ago. I will also point out that as the DCA were acting as their agents ,the OC have committed an offence under the terms of the CC ACT . Which also means they are not permitted to pass my details to ANY OTHER COMPANY .
    A record must be kept of any letter sent or received .

    What if the debt is sold to a DCA? Who has the right to take you to court then?

    The DCA would have that option if they owned the debt . They still must have a legable copy of a true signed CCA .
  • and dca will not in the main take you to court they will just ask , pester, ring , send letter after letter my advise change your number pay what you can , everything by letter , do not enter in to phone chit chat and get on with living your life .
    the dca bought your debt let them worry about getting the cash , if the are collecting for the oc them the oc will get the message if you aint got the dosh you aint going to pay.ahhhhhhhhhhhh

    Hi all,
    Been reading this thread with interest. Could someone clear something up for me? Should a proper notice of assignment come from the OC or the DCA? If from DCA it just strikes me that anyone can write one out and make claim.

    Sorry if I've hijacked the thread!!

    You can always ring the OC on reciept of letter to check !

    I don't ring these people as even recorded delivery is cheaper than some of the 0870 numbers you have to use to call OC's. I've written and after 3 weeks have had no response back. I'm simply curious on the legal angle. If a Notice has not been properly issued then surely it can help your case with regard to any agreement not being enforceable.

    In the past I have rung the card company on receipt of a notice of assignment to a DCA . The contact number should be on the letter , you can ask them to confirm what they have said in the letter . I have received a very dodgy looking letter forwarded by a DCA , saying account had been sold to the DCA . It looked as if the DCA had photo copied the card companies letter head .
