Do you mean bank charges fiveyearplan? Yeh we missed the boat on that one. By the time we got around to claiming the hold was put on. Got our claim in with barclays, Lloyds tsb next. Maybe we'll get it back one day. Tried the hardship case with barclays with no luck.

Personally, fyp, I feel it may go well beyond any 'unlawful charge' remit. I just think that the whole way that CC 'handled' the situation needs reviewing, from the 'serving' of the SD to the whole issue of 'charges'.

I was thinking if it was an ordinary county court case they could counterclaim but I don't think that is possible in a bankruptcy. I don't see how you can pay charges that aren't itemised but also agree if it was a choice of paying (and I could find the money) or going BR, I would pay up.
Saying that, Maz hasn't said she's in any other financial distress or maybe this BR would have been beneficial.

You are so right Rog2. I am trying to put as much info as i can on here, so ,hopefully if this happens to anyone else they are forwarned on what cc are capable of.
If anyone is having trouble getting payments to conaught (they refused payment from me) then i have their account details if needed.

Exactly, maz, and don't let the fact that you have paid money to this 'crowd' put you off from checking to see that their actions have been totally lawful.I am NOT, nor do I profess to be, a Qualified Debt Adviser. The charges of £2,111 are probably petition costs. It is common practice for the petition costs to have to be paid in full before a creditor agrees to the withdrawal of the petition.
Petition costs are usually between £1,000 and £3,000. They are fairly high as they include the legal fees for the petition, the costs for serving the petition and the bankruptcy petition deposit.0
