need help with creditors petition

    Named on the petition but not stat demand. Tried several times to speak to someone there but they just ask for everything to be put in writing. We have done this but had no response and we only have just over a week to get things sorted. I'll try the number you found. Thanks rog2.

    Been into court today and filled in form to oppose the petition. Stated grounds that moorhead and Connaught will not inform us of fees we owe. Worth a try and it made me feel a hell of alot better fighting them instead of being a victim.

    Sent solicitor a copy with court stamp. See how they like it!

    Oh well, Connaughts solicitors have just emailed me the costs. £2111.00 !!! We have got to pay this before the hearing next monday. I cant believe we have to pay all this money.

    Any advice?

    Have they sent a breakdown of costs?

    No Rog, no breakdown of costs. Just says costs up to and including 11th August. Just spoken to Community legal advice and they said if we bring this amount below £750 they can't make us bankrupt. A family member has offered to help, so we are going to do that.

    If they dont withdraw the petition we will still have to go to court and prove we are willing and able to pay the remainder.

    Thanks to Fermi for the advice, I,ll give it a go.

    Well, personally I feel absolutely 'gutted' for you, in that it has gone this far. I can not help but think that there is something not quite right with this bankruptcy petition.
    Maybe there are technicalities in the way that the SD was 'served', certainly there would appear to have been inconsistencies in their approach, but they appear to have 'time' on their side, rather than yours.
    Even if you DO pay what they are asking, in order to 'avoid' the bankruptcy, I would still be inclined to set the whole thing in front of a solicitor who could, most likely, tear the way that CC have dealt with you into shreds, question the legality of their petition and generally give them some of the brown stuff that they have made you go through.

    I totally agree with you rog. In a way i'm half hoping we still have to go to court and the Judge take a look at the stat demand and petition because i feel like we've been 'done over'.

    I've a feeling the stat demand is wrong because the wrong court was named on it for us to set aside at. I just wish that we had formally set it aside at the court instead of believing Connaught that they accepted our payment proposals.

    Its just so frustrating when you dont know how you stand legally and they are not playing fair!

    Hi MazLass, sorry to hear what is happening. If you manage to settle everything before the court date (Monday!) I would still go to court. I wouldn't leave anything to chance or anyone sneaking behind my back.

    Well the bravado of the last few days has left me. Paid £1500 into the solicitors account today, leaving £611 remaining. Started to think, what if they add charges to this and bring the amount over £750 again. Will they issue another petition? I think i am just going to pay it all tomorrow and put an end to it, go on holiday and be able to relax. Does anyone have any thoughts?

    I don't see how they could do that, maz - I believe that they may be entitled to add 'interest' at 8% pa until the bankruptcy hearing, but even that would be 'pushing it' as far as these 'clowns' are concerned.
    I hope you enjoy your holiday, and I really do hope that you are going to 'fight' these chancers when you come back.
