Selling a contract phone

Hi, I have a pretty decent Sony Ericsson mobile phone on contract. Im happy with this phone and from what i see on offer to me on the same tariff, there isnt a much better phone.

So im asking, if i take a phone with my next tariff, can i sell the new phone and keep my old one?

My instinct says that it is the tariff that im contracted too and the phone is just a gift - but i dont want to sell it and then find out otherwise

cheers
