Terminating Orange contract

Hi,

Has anyody experienced the same issue as I have when I terminated my mobile phone contract with Orange.

As the end of initial contract approached, I gave them 30 days notice that I was terminating the contract. They tried to get me to take a Pay-as-you-go SIM so I could still use the phone if I wished.

I refused the offer, stating that I already had another personal mobile phone, also with Orange. Plus I also had a mobile phone supplied to me by my company. However, they sent it anyway, so I just binned it.

This was in April of this year, I expected my final bill to be in May.

Just 2 days ago, I received my bank statement in. It shows a payment was also made to the cancelled contract in June. I also received a new invoice from Orange for July. When I contacted them, they say that although I correctly phoned them to terminate, the PAYG SIM the sent me should have been activiated to make the termination process complete.

I argued that I was never informed of this and they said it was also in the information sent out with the new SIM.

They say they are not going to refund me for Junes bill, but as a goodwill gesture they will refund July's when they get it from my bank later this month. I immediateky cancelled DD at bank.

As far as I am concerned, they have stolen £45 from my bank account. Does anyboidy have any idea what I can do to get this back?

    If it was DD go to the bank, tell them the contract was not renewed and get the money credited back. Be savvy and say 'not renewed' rather than cancelled.

    Write them a letter stating this was unlawful. Put as much info as you can (i.e. the date you rang them to cancel, etc).

    They may respond negatively but just keep writing to them until you get the money back. It may be a hassel to write once or twice but I guarantee you you'll get it back if you do - 45 quid is nothing to them to get you off their backs. Particularly if it sounds like they were mis-selling (see OFT for more on this) by not explaining to you properly the cancellation terms. You could also check the original contract to see what it says about methods of cancellation. You could also threaten to move to another provider once your other Orange contract is up.

    Make sure you do it by letter tho, as this is the form of communication they take most seriously (as opp. to email/phone call).

    But it keep it easy to read and breif where you can.
