How old is the item? Do you have any other proof of purchase?

Your rights are academic unless you can prove that you purchased the item there.

if the item is faulty which did you want a credit note rather than a replacement ?

unless you have a receipt then they only have to provide you with a replacement - store terms

Store terms do not override statutory rights.

Here is an excellent guide to your rights under SOGA. As you have taken the item back in a reasonable time, then assuming you can provide proof of purchase (a cc statement is sufficient), you are entitled to a refund (you do not have to accept a credit note).

You do not need the receipt however its not unreasonable for the shop to see proof of purchase so your credit card statement should be sufficient. If the item was faulty you are entitled to your money back.

...as long as you can prove when you bought it. If you have no receipt, the store is not obliged to take your word for it. If you take in the credit card statement, they might accept that (but they might not as it does not specify the item, just the amount & date).

A cc statement is sufficient to fulfil the proof as purchase criteria. If the store are in any doubt, they have the facility to be able to check what the customer purchased at the relevant time.

so, what should i do now?
is it worth writing to head office?
    thanks
  • the reason shops will not refund your money without a reciept is a legit thing. Many shops have problems with shop lifters who steal goods then take them back for a refund so now they just offer you store credit

What did you do in the end - did you accept the refund or retain the faulty item?
