To the OP - ignore the minority of idiots who seem to lurk round here looking for someone to talk down to.
It is well established in law that councils can in some circumstances be liable for property damage as a result of failure to keep the highway in a good state of repair.

You may be able to see when the pothole was reported to the relevent authority at http://www.fillthathole.org.uk/ which would help if it could be shown that it wasn't repaired in the required period.
The period depends on the severity of the defect.

Thanks Throbbe, I am really surprised at some peoples posting in this thread, I wonder why I pay £145.00 a year road tax with poor maintained roads.
Anyway a claim was put in on 22nd July 2008 for a repacement wheel (fifty quid). The claim said TFL had 3 months to respond, which was 22nd October 2008.
I wrote to TFL solicitors on 24th October to find out why a response had not been made during their three month response time. Heard noithing.
Today, 30th October 2008, I telephoned their solicitors. They informed me they had written to TFL in August 2008 and September 2008 for a "road works report" but TFL had failed to respond to them.
I told the guy I wanted to complain, he suggested making a claim in the small claims court.
I telephoned TFL, and was passed arund from one department to the next (iecustomer service for buses, oyster information, customer complaints, street service, legal etc...)
Shall I submit a claim in the small claims court? anyone have advice in this area???
