Dear Moneysaving experts.
Wanted some advice, while driving on a london road a pot hole damaged my front near side tyre. The foloowing day it was completely destroyed and flate. I bought a new tyre.
I contacted the local council and was informed it was a Transport for London road. I telephoned TFL and told them my experiences. I was informed they will send out a claims form.
Should I wait for the form, or simply write a complaint asking for a refund on the type and some compensation for inconvience, and phoe call? I just read an article from which which suggested I tell tfl to make a payment within 14 days or threaten legal action, is this a little strong or should I do this?
anyone has any advise, suggestions or even an opinon, let me know, thanks

I'd go take some photos of the offending pothole right now (with something standard like a coke can in the pic to show size) before the fill it in and you lose your evidence.0

I heard they only pay up if they have already been made aware of the hole, someone has to find the hole, this time it was you.0

well I am glad I helped them keith.
I was going to send them the following, what do you think:
Dear ________
On (date) I was driving along (road) when my near side front type was damaged by a pot hole.
The following day I discovered the damaged type was now flat and non workable.
You are responsibile for the maintaince of this road in good order. The condition of the above road is clear evidence that you are in breach of your legal responsibilities.
In these circumstances, I am legally entitled to claim compensation from you. As a result in your faliure to maintain the road properly, I experienced damage to my near side front wheel and inconvience for the use of my car.
I therefore claim compensation of £55.00 for a replacement wheel and a further £50.00 compensation for inconvience fof locating a local dealer to replace the wheel, phone call to TFL on Wednesday 16th July 08 and my time in logging this complaint.
I look forward to receiving your cheque for the total amount within 14 days. If you fail to reimburse me I shall have no alternative but to issue you a claim against you in the county court for recovery of the money witout further reference to you.
Your Sincerely,
____________

Must've been one hell of a big hole to have done that damage. Big enough to see and avoid....0 -
As Conor said sounds like a big un, you don't mention enclosing any receipts either.
Compensation can't be claimed for pure economic loss either, as you have not suffered damage or injury.0 -

You drove into a pot hole, it damaged your vehicle, you now think that it's worth TFL paying you £50. If you had payed attention you'd have driven round it.
Your letter also means that your claim has very little standing in an English Court, litigation should always be the last course of action, yet you seem to think that if they don't bow to your demands then it should be a visit to Court.0 -
Look out for pot holes. Avoid them.0

The road was a one lane road, all cars were driving over the hole, not sure if this is helpful, the accident happoned. its a bit like asking a pentioner to avoid a broken chipped pavement. As for the legal stuff, thats the sort of stuff you see on parking tickets, and as mentioned above, a book from the consumer book from which
