help for a lady in distress

Hi, I just wanted some advice please, was stationary in traffic on a slip road awaiting to join main flow, (traffic lights not working!!) when I was rear ended, is there any circumstance where the other driver can say he wasnt to blame?

  • nothing at the minute, my insurers have spoke to his who have sent him some form or other (he is with age concern) just worried :confused:

    no circumstances whatsover can he blame anyone else, it is always the fault of the person who
    does the bumping, he was either going too fast or not looking or driving without due care and attention. So please dont worry a jot. He has no excuses whtsover.

    There are a few circumstances.
    Like the other driver could claim you reversed into him.

    However if you are rear-ended then the benefit of the doubt is very definitely with you.

    Did you get independent witnesses? (as there was stationary traffic).

    If you have an independent witness who says you were stationary then that will make a very strong case.

    If it's your word against the other persons then often people lie through their teeth, however the benefit of the doubt is still very much on your side.

    I don't think it's as concrete as that.
    I'm certainly not trying to be alarmist, but it is possible for some to lie and say that the OP reversed into them.

    Not a problem if there are witnesses who say otherwise, but if there are no witnesses then all bets are off.

    I'm really not trying to be alarmist, but I don't think at this stage you can say anything totally cast iron.

    But there is no point in worrying yourself to death over things that haven't happened yet.
    I know it's difficult but try to stay calm and deal with whatever happens.
    The worst case may never happen so there is no point worrying over it.

    Only other thing that comes to mind,is that being stationery (due to the traffic jam) you positioned yourself in a hazardous position (ie just round a bend and the other person had no chance to stop in time)
  • he had passengers, and I didnt, i suppose they could lie!!! people passing in cars would have seen but no one stopped:mad:

    I wasnt round a bend it is a straight slip road, just leading into main flow, could insurers believe i was reversing?

    yes i probably am worrying too much but its my second crash in 2 months last one not my fault either and car was written off, just panicking
