    I've certainly learnt a lot about sections 8s, so its not been a complete waste of time.
    guppy - at the moment, there is no clause about late payments, but after this experience i'll certainly be adding the clause to all future tenancy agreements.
  • Thought i'd give you guys an update.
    well, his last payment was.....
    ......LATE again. I waited 5 days after the money left his account, and then challenged him again.
    The reason this time was that all his money goes out on the same date, but mine is the only DD, all the others are SO (so they get priority?). anyway, as he has private banking, he has a £17 account charge. once all the SOs are gone, it then takes his account charge, and then tries to do the DD, but it fails as there was insufficent funds (by about £3). so it doesn't work, and it can't use the overdraft cos he hasn't got one set up.
    so now he says he's set up the overdraft so it shouldn't be a problem next month.
    net result, i had to go round and pick up the money (cash) again.

    i'll keep you updated about next months excuse.
    in case anyone is still wondering why i dont serve him papers, which i sometimes question myself, is cos the flat is always clean and spotless, and he does a lot of travel with work (less wear and tear) and i think he can potential be a long term tenant (if he can sort out his finances!)

    I have a similar tenant; keeps place clean, pays rent but always late. Sometimes its easier to stick with what you've got than put up with the hassle of evicting, searching for a new tenant and risking a void.

    The difficulty is where to draw the line between taking the mickey and a temporary blip.

  • i think the small hassle (i live about 5 mins from the flat) makes it ok to deal with the lateness. but as you're pointed out, if he starts taking the mikey then I dont think i'd thinking twice before serving him papers

    CALL HI S BLUFF - change the payment date on his tenancy agreement to a date that suits him - ask him to pay an additional amount to make up the extra days - THEN see if he is taking the mickey next month
