    at 7:31 pm yesterday you posted that you visited the tenant, then today at 10:30 he has the money at home. Also you are a very lucky person no only does he have cash at home, but his payments have been sorted out too - you are being paid twice.

    He has very cheap rent, as he is able to go to the cash machine and drawer out 2 months rent, or did he visit the bank this morning, then drive home, then back to work?

    Wonder if his payments were left in the boxter from this morning run and now the car had been stolen. But the insurance cheque will soon be through, and once that is cleared? :)

    Serve him the papers and get rid of the sod!

    Went to see tenant at 5:30 last night to see if he indeed had the cash. He sent a text about an hour before i was due to see him to say he'd popped out, but that he left an envelope for me with the porter. I called the porter, and he confirmed that he had an envelope with my name on it.
    I called round, tenant wasn't there (was he avoiding me?) but the porter did have an envelope stuffed with 50s and 20s to the tune of £880 (rent is £875 - but i'm keeping the £5 for all the hassle).

    So now he is only 16 days late with rent (for July). Will see what happens in August 1st and serve s8 accordingly if i have to.

    Thanks clutton for the tip on the s8 regarding rent due, rent paid and rent arrears - shouldn't i also include something to show the due dates and the actual dates? this will then show that he has been late with rent?

    Clever...he's cleared June's and partially paid July's rent. Now you can't touch him until 1st September :cool:

    You can waste your time, and money, over a ground 11 notice or just issue a S.21 notice.

    Or carry on being taken for a mug...

    I know people on here may think i'm being taken for a mug, but im happy to wait till 1st September to see what happens. He's always paid before, albeit a little late.
    And if come 1st Sept he hasn't paid, then I'll issue the s8.

    If you issue a s21 notice now you do not need to act upon it if he pays up. however it will safeguard you should he fail to meet the payments as and when they fall due. Issuing the notice may make him realise you are serious and that he should not be taking you for a ride. s21 notice issued now with a expiry date AFTER the 3oth September will at least allow you to regain possession if he does not comply. It will not cost you anything and is valid until you retract it in writing so it will keep him on his toes in the future.

    If he has genuine problems then it may also make him sit down and discuss it properly if not with you with someone who can help him.

    Think about it you will be giving him a chance to prove himself and safeguarding yourself at the same time, also as Clutton says you should always issue a s21 and a s8 at the same time to avoid problems if tenant pays off part of the arrears.

  • I've been aprivate LL for 8 years too and have been caught (significantly)only once too....I STRONGLY support Clutton's posts and would take the same course of action to minimise my exposure.
    Clutton is a regular poster and (IMHO) posts solid, sound and correct advice.
    Still...that's what a forum is for, exchange of opinions and advice from all sorts of different perspectives.
    IMHO Section 8 is problematic to say the least....the tenant needs only part pay the arrears on the day of the hearing and it gets thrown out. I would always go with Section 21 and then chase separately for unpaid rent, but be prepared to get in the queue for unpaid debts if he is as carp with £ as it seems!

    You don't sound like a mug, you sound like a really decent person. However he is taking advantage and why would you want all this agro and uncertainty? It must have taken you many hours to do the above.

    And as guppy said, you need a late payment clause, including charges and interest.
