    The OP was also acting outside of ebay rules as well. However ebay don't seem to be as hard on people offering to buy especially where they want to deal on ebay as they are on unsolicited mail to under bidders. Probably something to do with what fees they reckon they will end up getting (not that I'm cynical you understand!).

    Well, I think it would be against ebay rules to offer to buy them straight out, but I wanted to know if she was relisting them and said that if she did it as a BIN, I would buy them. I don't think that is against the rules.

    Just as if you emailed a powerseller a question saying "i see all your other auctions for a 1.5m usb cable and that you were selling a 3 m usb cable last week, are you selling any more 3m usb cables in the near future as I want to buy one?"

    That is a bit different from emailing something like "Missed your auction, want it cheaper, will you sell to me outside of ebay?" LOL

    Then again, ebay has SO many rules and regs that I'm sure there a chunks in there that contradict each other - I think they were written by different teams that don't talk.

    bluep, the distinction between wanted spam and unwanted spam is I think dealt with by ebay on a logical basis.

    It is against he rules to contact other users unless you are in a transaction with them, or have been in the past. However, as I said in my response above, ebay don't seem to act on reports of buyers asking a seller if something is going to be relisted as although it does break the rules it seems a logical thing to do. Also if that item is then relisted ebay will get a cut of the fees.

    However, ebay do act on reports of spam where sellers contact underbidders on other users auctions, there is a category I buy in that I regularly receive these spam mails about. I report them all to ebay and on occasions the seller making the offer is suspended within days.
