What's the competitors site? If he's copied you wholesale and is actually using the image on your server, with a little bit of smarts you can replace that image on his website using a small bit of code in a .htaccess file - you could put ANY image on there - it'd be hilarious.

But in order to win an copyright case, you'd have to show that you were the original author, that it's an original idea, and that copying it don't constitute fair use. That you can show you had a copy of it before one other person doesn't prove any of this.
You could have copied it from someone else, in which case your breach of copyright claim would be rather specious to say the least.
The best thing to do would be to keep drafts, rough versions, etc. Remember what your maths teacher said: show your working out kids!
True, but equally the other party would have to claim that too.
I can't really see this is an issue, because the other party is in exactly the same boat, they have to prove they had the site (or idea or whatever) first, and to do this they need some tangible evidence i.e. dated and confirmed, signed or registered before you.
However my example, simply relies on you proving: you had the idea first - and to prove you had an idea, it must be written down, registered, date stamps by some official manner, or if it is a patent, obviously registered.
It's a known technique one I've come across in IP law. Others include registered copies with solicitors, or even taking a copy to a bank, dating it (stamped by the bank) and having it entered into their vaults, there are all sorts,0 -
There might be some date and time stamps on the files on the web server to show that this site is well established, plus the hosting co may have an old backup that also proves it.0

Of course if he is linking to your images then all you need to do is move your images to a different location and redo the links on your website. Then you can change the images he has linked to to something, aaaah slightly less savoury.0 -
Please post up the link, OP. I'd like to see the source code. We'll see soon enough if he's lifed it wholesale! Or even better:
1) Find out whether he is linking to your images or not. Post a link and we'll tell you if he is.
2) If he is, move the images on your own site (and their references in your pages) and replace them all with a large image that is simply text saying "we are plagiarising www.chocolatefountainshire.co.uk". Add a message plugging your own site if you like!
3) Go to your competitor's page. Refresh it to get all of your images up. Print out a copy. This will be very useful to you for proving he is ripping off your site.

I have had one of my webpages copied in its entirety including photos. I only found out today as someone wants to use the aura photos & write-ups in a book so asked my permission to copy MY websites - which included one that doesn't belong to me.

Can someone please tell me if the photos are linked to my website/server as I'd like to replace if they are with something he/she won't want on their website
