    I'm not going to court. I probably won't even threaten any ebay action. I'll just make an offer and see what happens.

    You should make the complaint. If you make an offer, its giving into sellers who think they are above the rules. The bad sellers need to be weeded out.... Here you have the perfect opportunity to help aid that process.

    Just to bring this into perspective;

    You're talking about someone who's made their FIRST listing, and has put their foot in. And you're all chanting court, contracts, blood blood blood.

    Christ alive. Get her telephone number and give her a ring! Is there really any point in making the world any more crappy than it is already!

    There's absolutely no point in going for the juggular. None of you are important, she's not important, and I certainly ain't.

    As it is the sellers first sell (thought I thought you needed a feedback of 3+ to sell) going through item not received process would be fruitless as they could just sign up with another eBay account.

    Send them an email (through eBay) with a link to the rules of eBay i.e. binding contract. It might just scare them! :money:
