Car Accident settlement - Am I being offered enough?

  • In late 2006 I was involved in a motorway accident. I was on slip road about to join the motorway when a van came from the left & hit the front passenger side of my car. My car was then pushed onto motorway, I lost complete control of the car as it zig zagged across 3 lanes and eventually spun round & crashed into central reservation facing oncoming traffic. Car was complete write off. Luckily no one else was hurt & no other vehicle damaged. I had whip lash injury but it didn't become apparent until later in the day.

The other party eventually admitted liability in late 2009 but my claim is still ongoing. I am still suffering with pain & stiffness in my neck, shoulder & upperback areas. The treatment I have had was just pain killers prescribed by A&E initially, more pain killers prescribed by my GP some weeks later. I then started to see chirporacter privately over a matter of 2/3 months. I felt this made some difference. I had to stop because of financial constraints. During all this time I still kept going to work & doing my usual day to day stuff, etc. but I was by no means comfortable....was told to keep moving/active was the best thing for me. I still have soreness/stiffness in neck, shoulders & upperback...sometimes pins n needles in my neck.....am also starting to get them in my hands..

In March this year I was assessed by an orthapedic surgeon who advised that I still haven't completly recovered...he advised for some physio....for which the other partys insurer has still not sent appointment. He also advised that I was not to lift anything including my children....this was impossible as I had just had a baby & was potty training my 2 year old.

I was also sent for an assessment by a phyciatrist a month or so ago for my reluctance to drive & my anxiety when travelling as passenger on motorway. I have to rely on my husband for transport now for travel to work, appointments, etc....as I can't get behind the wheel.

Their initial compo offer was £3k, then £4k, then £5k...all were turned down. If anyone had said to me 3 or 4 years ago, they'll give me £5k to have all the problems I've had ....I would have turned it down as just not worth it.
