It's the sellers responsibility to make sure the item gets to you and in one piece. It didnt so its his fault for not wrapping it up properly.2008 Comping ChallengeWon so far - £3010 Needed - £230Debt free since Oct 20040

Thanks for the advice, people.
Now I'm annoyed. Today, I filed an item not received claim, and detailed that I had received an empty envelope. The seller has now filed an unpaid item claim against me. I paid through Paypal, so I don't know what they're hoping to achieve. They haven't yet left feedback, though. Why do I get the feeling I could be in for some undeserved negative feedback?0 -
If you paid by PayPal then how on earth does the seller expect to successfully file an 'unpaid item' claim against you? God, what a dork. Yes, probably a neg heading your way though

I have an unpaid item strike against me, which I am now appealing. I'm not quite sure how that happened! The seller alleges:
" BUYER HAS STOPPED PAYMENT AFTER RECEIVING CARDS BLAMING
THE POST FOR STEALING YUGIOH CARDS HAR-HAR! REASON FOR FILING NON-PAYMENT = STOPPED PAYMENT".
The payment was made on 17 September from my Paypal balance. I have checked my e-mail and Paypal account, and I have not received a refund of this money, nor any notification of a ruling on the item not received dispute, so I don't know how I'm supposed to have stopped the payment. Even if I had received a refund, I did not receive the goods, and I don't see why I should be penalised for using due process in an attempt to recoup the loss. I'm also angry that the seller has the gall to accuse me of fraud.
I've just spent ages finding the relevant information and filling in the appeal form, only to have my computer unexpectedly lose the internet connection, so I've had to do it twice. Now I'm really !!!!!! off.
Sorry if I'm rambling, it's late.0 -
The bad news here is that ebay do allow an NPB to be placed against a buyer who received a refund under a chargeback. However, he may have filed too early and done himself a disservice as at the moment technically you have still paid.
As long as you keep an eye on the dispute and respond to everything that shows up in the resolution centre you might get away with this without a strike on your account.
Be polite, be factual and don't use the resolution process to make allegations about the seller, that way he looks bad as he sounds like he is ranting a bit.
As for the neg, try complaining through the ebay system as he mentions you filed a chargeback, that might just breach the no details about the transaction (new ) rule and allow ebay to remove it. It is a long shot but worth a try.

They still haven't left feedback yet. I'm trying to figure out how to squeeze all the negative feedback I want to leave into only 80 characters! Does eBay in the UK allow recipients of feedback to add a response? It wouldn't solve the fact that my score would be less than 100%, but I'd like to explain that I was not at fault to anyone interested enough to look.0

You can leave an immediate follow-up to your feedback to get 160 characters. The recipient is allowed to leave a reply, which will stand as the last comment in this scenario. Otherwise, you can leave feedback, the recipient replies and you can follow-up the reply.Contains_Mild_Peril wrote:They still haven't left feedback yet. In other words, the person leaving the feedback gets to make 2 comments and the person receiving it gets to reply once. I hope that makes sense.

The unpaid item strike against me has been removed, so I'm less annoyed now.0
