DCA have messed up! I'm taking them to small claims, they are fully defending it

    In a case where a company like EGG contravened the financial rules and guidelines, then there is a strong case for a complaint and in your case compensation. Thats the way it should be . But these DCA IN MANY CASES ARE NOT REGULATED ! Complaints to the OFT AND THE LIKE about these DCA have no effect .

    You are wrong stapely if you if you are making a formal complaint and put what you want to achieve you get it. Happened with me I got more than I wanted actually but I didn't complain.

    You seem only interested in your "cause" which is very narrowminded there are other alternatives and I wish OP every luck he will go a good way with a letter like that.

    Okay we will see . I wish him well . But look at the facts . Has he a recording of the conversation?
    NO

    Does he owe this company money ?
    YES

    What do you think will happen ? The OFT write and say " your employee has been very very rude , please write off the debt "
    Sorry it will not happen.
    My point is, I would rather be writing a letter saying " I am very disappointed that you have been unable to comply with my request for a TRUE SIGNED COPY OF THE CCA ,that relates to this account . I therefore inform you I will be making no further payments to your company . BEST REGARDS .

    Yes I am a she, and guess what. I got another phone call this evening from CFS apologising for the rudeness, telling me that the person involved is going to be looked at through internal discipline measures AND HOW MUCH MORE CAN I PAY A MONTH. This was at 8.50pm!!!! I am furious! Spitting mad. What now. ARGGGHHHH!!!!!

    Oh and they have refused to accept my offer for a full and final settlement.

    So they called you after you formaly wrote to them and said

    "If you contact me via the telephone I will view it as harassment and you will be in breach of Section 40 of the Administration of Justice Act 1970 and the Protection from Harassment Act 1997. You would also be in breach of the Communications Act (2003) s.127 and I would report you to OFCOM, Trading Standards and the Office of Fair Trading, meaning that you would be liable to a substantial fine. "

    I think another complaint is now due!!!!!!!

    They had obviously had the letter as they are dealing witht the complaint and refused the settlement!
    I am a debt counsellor working in the voluntary sector - we don't charge our clients for the work we do!
