Have I any rights or chalk it off to experience!!!
I was on a £35.99 mobile phone contract with Carphone Warehouse through O2, before it finished I was offered a free year off peak as I was looking to cancel after getting a Company phone.
Instead of cancelling I accepted it thinking I could use this at weekends for free (my credit was apparently £300). The offer was a free year & 750 mins/125 txts each month, at no point was it pointed out to me I was actually on a £25.99 per month tariff and this £300 paid it!
CW then started this new contract a month before the existing one finished (something I believe would not have been alllowed to do) and unaware of this I continued thinking I had inclusive minutes for that month. I am now told I used up £40 of the credit that month which now means I have to pay the £25.99 tariff for the remaining months! there were also a couple of months I used it in peak, very minor amounts which I am happy to pay.
I have complained re: miselling and they will try to find the phone conversation but say that he should have quoted a piece of txt explaining this and that was that.
Do I have any comeback on this legally does anyone think? personally I think it was clever deception and I my just have to pay up and chalk it down to experience, nothing is for free as they say.
