Tenants in common - buying each other out
Hi All, Would appreciate advice on the following: My husband and I are separated but own a property (where I live) together, as tenants in common. He suggested that I buy him out - what are the legal implications of this? Will there be some tax to pay? Will the mortgage have to be changed? Thanks.

Why does anybody buy off-plan abroad?
I have noticed a few threads on here about people having problems with half built developements in places like Bulgaria etc. I have been thinking about this and cannot understand why any body would buy before the property is even built. Why not wait until it is at least finished before handing over your cash. Maybe I am…

Can an easement be extinguished?
Hello all. I live in an end of terraced cottage with a long garden to the side (if that makes sense). in 1976, before i lived there, my house was split into 2 houses and the garden was also split into two. So the neighbours then owned the furthest half of the garden. at the same time, an easement was written into the deeds…

Approximate costs for Solicitors?
Hi there, I have just recieved two very different quotes for buying my property (135K). The first is from Countrywide property lawyers who quotes £1600 total and second is from Close Thornton £680. Both include legal fees and disbursements. Am I missing something very important or is Countrywide really overpriced? Thanks…

Where to start?
Hello all! I know this is a common question but I thought I'd seek the forum's opinion. I am a FTB (buying due to new job and overpriced rental market) currently looking at a new build 1 bed flat by George Wimpey. The flat is listed at £79,995 and to be fair it seems like a reasonable price, however, I know this is a…

Asking price of a new build
I am looking at buying a new build property which is up for £169,995. A bit of investigation shows that the exact same property in the same road was bought as a new build for £174,950 in June 06 Given the current climate should the asking price really just £5k lower than it was 2½ years ago?

Estate Agents just don't listen!
This really isn't complicated, my dad is buying the property and I will rent it off him to cover his loss of interest especially following the recent BoE rate cuts. As such he wants me to find a suitable place, should be easy! Budget is set and was based on affordability and some online research of properties in the sorts…

Can te guarantor terminate the tenancy agreement if still in fixed term?
Hi guys, further on from my previous thread re guarantors: http://www.landlordzone.co.uk/forums...t=16000&page=3 I need to consider this. The contract for tenancy does not include me anywhere only in guarantor form, which can be seen on the thread link shown which i have typed out etc. If the tenancy contract was fixed for…

Deposit for previous tenancy in dispute
We lived in our previous address for 18 months and paid £1050 deposit, with £750 for a month's rent in advance. After leaving the property in November last year (17 months to be exact) we have only received a cheque from the estate agents for £202.50 as the rest is in holding while it is in dispute. To cut a long story…

What is a 'reasonable charge' for a home information pack?
Im a first time buyer just trying to learn the ropes with the house buying process. My estate agent is trying to charge £25 for me to have a copy of the Home Information pack... I have checked the govt website and it states that a 'reasonable charge' can be made for photocopying and posting... £25 seems a little steep to…

Help needed...
...my girlfriend and I moved into a flat in Sheffield as she's doing a PGCE there but I was working in Manchester at the time so I didn't move in until I got a job in Leeds. We told the council as soon as I moved in and I've been paying council tax. The estate agents knew the score and I paid a £60 registration fee as a…

Would this be viewed as a private sale?
A bit of background: OH & I looked at some houses last week 'to get a feel for the market & see what is out there'. We happened to find one that we liked that has the added bonus that the owner will consider a part exchange type deal which is great as houses in our town haven't been selling for over a year now & the only…

Stamp duty
Hi all, I'm buying a house for 250k, checked online, and appears that I only pay 1% stamp duty, the next threshold starts when you pay 250,001. However everyone (well meaning friends and family) keeps telling me I need to pay £249,999 to avoid the higher stamp duty. What's the score? Would ask my solicitor but it's a…
