Not on Benefits - No Money for Funeral?
Hi, My friend's mum has just died two weeks ago and he's got a ton of stress on him right now. He's still not registered the death which he's going to do tomorrow I think. There was incidents with the treatment in the hospital which he was delaying it for as well. He's not on any benefits, has been sole carer for his mum…

does writing on a will invalidate it?
My mother-in-law is quite isolated and house-bound. She has memory problems but is not mentally incapacitated. Her will was witnessed by her neighbour, and the neighbour's gardener. I have found that she has written and signed the will next to the signature of the latter 'I do not know this person'. Does this invalidate…

What happens if an invalid will is sent to probate office?
My mother recently passed. My sister is holding the will and intends to act as executor as the will states this. However the will is not witnessed. Therefore I believe it to be invalid. My sister does not feel it is. If she applies for probate do they even review the will to ensure it meets all the points to be considered…

Identifying the witnesses of a Will
Hi does any one know if you need to be able to identify the witnesses to a Will to make sure that it was properly executed/ valid? I ask this as a family member’s Will is in dispute. His Will appears to be witnessed by the presence of two undated signatures, under his, but the signatures are difficult to read and aren’t…

Nil Rate Band Discretionary Trust
I had an interesting question recently and was not sure of the answer. A fairly common Will, but I was concerned about one part. Both husband and wife held their…

Using copy of your will to make another
I hope this is the right place for this question. I think I have lost the original of my will. I have found a photocopy. As there are no changes at this stage, can I date, sign and get it witnessed as my "new"will or type out date, sign and get that witnessed? A couple of bereavements in the family has made me want to make…

Hypothetical "new will" question
The current "New Will" thread made me think. Suppose you held a copy of X's will, because you were named as executor in it.And you met with X from time to time and all seemed normal. Then X died and you started the process and perhaps handed all the bequests out. And then you, or someone else, discovered "new will",…

Charity legacy
My late mother's will contained four legacies to various charities. We've emailed all of them and received replies from three who are obviously happy to accept the payments. Will writer suggests 'substitute executor & trustee'
Son and daughter in law have made (first) mirror wills. They have appointed 4 family members as Execs/Trustees. Will writer inserts a "substitute exec/trustee" in casr any of the 4 are unwilling/unable. Sounds 'suspicious' ? (business relationship ?). He says he always does it. The substitute is Probate and Trustee…

Deceased estates notice
Hi, My wife is the executrix for her father's will. She has had the grant of Probate delivered this morning and we are looking at the next steps. I'm advised that it would be a good idea to put a 'deceased estates notice' in The Gazette, and also in the local paper. So we've registered at the gazette, and can see the form…

Is this trustee appointment legal?
Hi My Husband has received paperwork with regards to another trustee retiring and asking for him to sign and agree. However, this is the first time he has even heard that he himself is a trustee!
