Confirmation of small claims issued by PPCs 2012-2013

Here is the confirmation of the numbers of small claims by AOS members since POFA 2012, its startling reading, and just confirms what a nefarious trade this is. Its dated from the 01/10/2012 to 30/09/2013

    A few things can be derived from this

    List of companies who have not issued a single claim in the last 12 months

    New Generation Parking
    NCP
    Athena
    CP Plus
    Smart Parking
    G24
    ANPR Ltd
    Highview Parking
    Minster Baywatch Ltd
    Observices Parking Consultancy Ltd
    UK Parking Control (UKPC)
    Wing Parking Ltd

    DCA's
    Newlyn Debt Collection Limited
    Debt Recovery Plus Ltd

    Plus many more, compare here

    And

    1) Some NHS trusts have taken the small claim route
    2) A number of Universities have also
    3) It looks like some claims have come from parking incidents in Scotland through the small claims track in England (Dundee Uni)
    4) CEL's Claims have tapered off somewhat
    5) Whilst Parking Eye's have increased a lot
    6) A student union has taken someone to court?? !!!!!!?

    Appalling abuse of the court system, especially as there appears to be (anecdotal evidence) that very few full court cases to hearings have actually been conducted from all these papers issued, suggesting the system is being used purely for intimidation purposes.

    And all this after the BPA promised the Government that PoFA and RK liability would reduce the pressure on the court system.
    Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .

    CEL seem to be dropping court cases all the time once the motorist stands up to them and says "see you in court".
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    And UKPC are still not doing court, despite the introduction of JMW Solicitors in their letters chain in recent weeks.

    So another way of looking at this is that Parking Eye has issued on just over 1.2% of the total number of RK requests from the dvla. If you look at on the numbers of people who don't pay (30% ish) then they have issued in less than 4% of the time

    Useful stats Stroma. I previously guestimated 5-10% of unpaid charges get taken to court. It looks like that was too high and only 4% at the moment get taken.

    I graphed the figures in excel and it does look at if they are steadily filing more and more cases though.

    A notable PPC missing from that list is NCP. I presume that they are avoiding court as they are still shell shocked after losing Mayhook vs NCP. They eventually had to pay about £87000 in costs to the claimant plus their own costs which were probably more than that. http://forums.moneysavingexpert.com/showthread.php?t=4317481
