This is presented as good news but I suspect it is in fact bad news.
The flaws are as follows:
Only members of the British Parking Association's (BPA) Approved Operator Scheme which stands at 162 at this time are covered by the "Independent" appeals service.
(worryingly it smacks of the "independent" Police complaints commission - and we all know what happens there!)
(Throughout the country there are many more private car parking firms than this)
They aren't allowed to clamp anymore so it's going to be a lot more of these parking charges (fines as they call them).
Whereas they had to prove who the driver was in the past it is now the owner or keeper that they will harrass to pay these charges.
This point is the killer really as it was always the point at which a court would not be able to prove or affirm who was driving.

I've already answered this in the other thread that you've posted in, but the charges will remain unenforceable contract penalties, and the PPCs still have no proprietary interest in the land that enables them to form a contract with ANYONE, driver OR registered keeper.Je Suis Cecil.0

Even the BPA emphasises this in an internal memo:-
It has been drawn to our attention that there is much public concern about some operators who continue to indicate on signage, parking charge notices and similar correspondence that the keeper is liable for the payment of parking charges due as a result of a breach of contract. This is not the legal situation now nor will it be after 1 October 2012.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

Firstly, this article needs to be re-written with some urgency because as it stands it is substantially misleading and, in some respects, downright wrong. This should not be being made available to otherwise ignorant members of the public who come here for informed guidance.
As others have said this article reads much like similar articles published in recent weeks which were clearly based on BPA press releases. Given the resources and knowledge available on this board it is something of a slap in the face that you appear to have made no effort to seek the guidance of those of us here who have been working with the Protection of Freedom Act since it was a Bill and have an in depth understanding of the workings of PPC World.
Disappointingly poor.My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016).
