    Good to see something being done about this, many companies have the ability to prevent you going over your call / text / data allowance but refuse to use it.
    This was 6 months out of date so I've changed it.

  • O2 have applied the data cap to all countries not just Eu for over a year already. With the cap non eu the same £40 for 50mb.

    And if you are on T-mobile, you don't even have to travel abroad or use data to get bill shock.

    Tesco have been doing this for ages as well. As they use the O2 network, it was probably introduced back to back with them.

    I have got a very very serious problem. My phone got stolen whilst on holiday in Barcelona. (did not take insurance) I informed O2 when I returned 1 day after it got stolen & now someone has used to make calls to Burma, within Spain totallying up to £ 9.6 k. O2 are looking into it at the moment and maybe can do something but not sure and the wait is killing me.

    Any advise or thoughts of what I should do?

    Unfortunatly you are liable for the calls made until it was reported stolen to the network. You may get a payment plan set up, or get some good will reductions but unfornatly you will have to pay for this.

    Although too late now a Phone and SIM pin would have prevented this, please remember set and use on in the future...

    Firstly the company in Spain that o2 UK want to share with and send your money to is Movistar. It's o2 sister company.

    your best bet may be to pay the part you believe is yours and to dispute the rest in writing.

    Only a court can decide whether you are fully or partially liable for those charges.

    1. A Court may want to know why o2 despite being fully aware of this problem for several years were still insisting on loading the account with limitless poorly protected credit.

    2. A Court may want to know why o2 despite being aware of the problem of stolen phones were still insisting on passing on the revenue to the same international premium rate companies.

    Actually I'll bet it's really Telefonica who are o2 Parent and Spanin based.

    Verzweifelt is liable for the charges under the contract they signed with O2. If they wish to challenge it in court thats another matter but until proven otherwise unfortunalty Verzweifeltis liable.

    O2 would most likey argue that as they provided tools (SIM and PIN lock) to prevent this happening and insurance is availalbe to cover this eventuality then unfortuantly Verzweifelt is at fault for not taking reasonable precautions.

    As I said it's too late here, but what will it take for peopel to realsied they need to use a PIN on a phone, if your bank card gave out money without a PIN you would not leave it about as casually as people do phones.
  • Thanks for the replies - still waiting for a call from O2, tomorrow will be the day I think.
    I did have a Phonne Pin - not a SIM Pin.

    None of the calls were mine. If I were to pay the full amount, would there be any point of involving Ofcom? Or how would I challenge their decision in court?

    You cannot 'involve' OFCOM. They are not a consumer mediator, and sadly - it was your phone and responsibility. It is theft, so try on your holiday insurance. Incidentally even if you do not pay, you will never get close to court - as O2 will simply cease the contract and sell the debt to a third party to harass you - oh, and also wreck your credit file in the process.

    Two things though - there IS a cap of €50 so unless you arranged a roaming package, your limit should have been limited to this. Further, your responsibility ends when they block the SIM. How long did it take you to do this?
