Hey guys...
I sent a letter to simplybe about a debt ive been paying monthly to them on a payment plan (with reliable collections) who is part of their company.. The letter i wrote asked for my signed credit agreement.. they sent me a letter saying they dont have this, but sent an agreement (no sig from me) along with statements from when i opened account years ago.. and also said in the letter they can not force me to pay etc etc.. (quite happly type it here for you if you like)
I rang nationdebtline who helping me with this debt.. and they adviced me my next step would be to write to them again and request they take all information of my credit file because they did not have my permission to do so? is this true?
anyway this was 2 weeks ago, just recieved a letter from them again saying i owe blah not been in contact, ring asap or they will add more charges to my account..
also they will put default on my credit file?
what can i write to them now please? because by law they are harrassing me? as they can not supply my signiture on the credit agreement?
has anyone had dealings with these before? or been through same situation as me?
thanks for any help

Catalogue signed credit agreements are slightly different.
Have you read this link
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=32_catalogue_debts
my reply will bump it up more for people anyway.0 -
yes i got all the info from there too... the guy i been speaking to at nationaldebtline told me they can not harrass me its an affence under a certain act (have all details somewhere) ... AND they can not put info on my credit file because i never signed anything giving them permission?
just wanted to check if this is rightly so and if anyone could help me with a letter to get them off my file aswell as stopping them from harrassing me?0 -

Not sure about the catalogue part, but if they are required by law to provide a valid CCA, the template letters on this link may be of use. Post up what you intend to send and we can add or amend to suit. Also, when was this from? (6th April 2007 saw a change to the regulations). If before this date, then you should be able to follow the usual CCA request procedure.

Interesting....when ever i buy from a catalogue they always send the agreement but i have never in 10 years signed and returned one.....they never ever even ask for it when i fail to return it.
If you buy on the Internet form a catalogue is it like one of a 'digital' agreement doodaaas where by clicking the box is considered a signature.'Beware of little expenses. A small leak will sink a great ship'. -Benjamin Franklin.0 -
hello everybody, i been away for a bit, come back and have my 3rd statement from reliable clollections that has £48.99 credit charge (which upon ringing then they refuse to believe?)
anyway i also have a letter basiclly sayign to me this will not be tolerated i bought goods and therefore i should pay for them (even though they could not send me my signed agreement)..
anyway nationaldebt line i spoke to this morning gave me 3 choices to do,
1) write to them stating i do not have to pay for the goods as i have no signed an agreement and you could not proove that i did however, and out of a good will gesture i will pay for goods only if you take off all interest and charges of my balance since i been with you..
2) ignore all letters as i do not have to respond as they could not supply me with a signed agreement. nor can they take further action because of this.
3) write to them again stating i would like them to leave me alone as they wrre unable to send me a copy of my signuture on an agreement, and therefore they are harrassing me for a debt thats uninforcable or i will take it further under section blah blah..
I would liek to go for option 3? but i do not know how to word my letter? could someone perhaps help me with a letter please?
many thanks0 -
anybody please?0

Can you confirm what you have done so far?
Have you sent the CCA letter with £1 payment? Was it by recorded delivery? After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91
