lol nobody visited me!! cheek of it, they will try anything wont they!!

Hey everyone, i recieved another letter from reliable collections this week well 2, 1 a statement and a nasty letter informing me they may sell my account over to baliffs basicly!

i printed out and sent them (recorded, been signed for) the template letter about harrassment etc! yet they still wrote to me..

the statement 12th july (dated) has £12,and a further £12 admin charge on same date (14th july) and a further credit charge of £50.45 and ofcourse a note on the letter to let me know that at the moment my account is benifitting of no interest being added (yeah right)..

the letter dated 14th july from them says the following.. all in capital letters and bold i may add

Your account is now going to be reassigned

This may result in debt collectors calling at your home

Take notice, unless you make a payment of this debt in the next 7 days an appointment will be made for a debt collector to call you at your home

To avoid this happening call us now on :

failure to respond will result in a default being registered on your credit file (already is)

in accordance with out clients trading terms an administration charge of £12 has been added to your balance (yeah twice)

this notice should not be ignored!!

its like they have completely ignored my letter telling them to leave me alone under harrassment !

whats my next step to be?

my balance is now at £2596.88 (4 months of interest and admin charges being added, which they has no record of interest, yet its in black and white infront of me! th ats why i requested true signed copy of aggreement which they could not send to get out of this debt )

    thanks for any further help!

I have just found a template letter from national debt line, please could you check it out for me ...

    Dear sir/madam

We would like to make a complaint against your company. The details are set out below.

    (put in paragraph of complaint)

We understand that you must send a written acknowledgement of our complaint within 5 business days of itsreceipt. If you are unable to resolve our complaint within 4 weeks you must send a holding response, explaining the reasons why and indicating when you will make further contact.

If you fail to resolve our complaint within 8 weeks, or if matters are not settled to our satisfaction, we willhave no alternative but to escalate our complaint to the Financial Ombudsman Service. This could result in
you being ordered to pay compensation if our complaint is upheld.

We look forward to your reply.

    Yours faithfully

in the bit where it states about the complaint, i am not sure how to word it?

Do you think this is ok?

I was with simply be for a few years and found it difficult to keep up with the payments due to the interest being charged, so i requested some help, and i was adviced to go with you reliable collections and all interest will stop!

But the past 4 statements all show an interest, when i first rung reliable collections about this i was told no interest has been charged, but infront of me on my statement it said credit charge £48.99 and this happened a second time.

I therefore seeked proffessional advice about this matter, who informed me that this was wrong, and request a true signed copy of my credit agreement, which i did but was ignored, i then had to send proof of my last letter i sent being signed for and within 7 days recieved a credit agreement (not signed) and statements from my account since starting, along with a letter basicly saying that this debt is not forceable.

I then kept recieving letters regarding this debt of a threatening nature stating someone will be calling me, and a further 2 statements adding extra credit charges, i wrote to reliable collections stating your continued pursuance of this matter constitutes an offence under Section 40 of the Administration of Justice Act 1970.

But i have since recieved a further statement with another credit charge and another threatening letter telling me my account is to be reassigned.

If it has now been 12+2+30 days since you asked for a copy of the CCA (with £1 payment) then you should send the final letter.

    HANG ON!!
You will need to be very careful about sending that letter. When requesting a copy of the cca which they are legally obliged to send you, you are stating that you do not acknowledge any debt to them. In your letter though you are referring to "may account" .

Have they sent you a copy of a CCA? But it is unsigned or has details missing (not a true, legally enforcable copy)?

Even though a CCA isn't signed - by you or them?
It may still be held to be a valid CCA in court.

Are you able to scan this in so we can see what is on it? Is it a CCA (possibly applied for over the internet?) or an application form? There are prescribed terms (certain things that must be incuded on a CCA) that will need to be on the CCA for it to be a valid copy.

If you are able to scan it, please blank out any personal detail sucj as address and account numbers.

It may be worthwhile posting the scans on this thread as there are a few people with CCA experience that view it regularly.

I'd also include a timeline of events so they can get a feel of what has happened so far.
ie DATE - letter received by them - brief detail
    Date - CCA request sent
Date - letter received - they state that they did not have a copy of the cca?

am sorry i dont understand :( all getting to much now :(

i started this thread with all info on, and have kept it all up to date ?

i requested a signed copy of my credit agreement, they sent me an unsigned copy of my credit agreement.

    i ignored any more letters

THEN the letters kept on coming, so i was adviced to send them a letter pointing out that they can not inforce this debt as they can not send me a signed copy of a credit agreement, so stop harrassing (used template letter above) ..

they are still sending me letters threatening me and also adding on more credit charges (even thought they not meant to)

the letter they sent me with my unsigned credit agreement i typed up in here on page 1 :)

to be honest whats going on now is they are pretending they havent recieved my letter telling them to stop harrassing me and are still doing this..

i have to stick to my word in my last letter to them pointing out i will take this further (bottom of page 1)

    they are still harrassing me..

    whats my next step?

    urghhh i could cry :(
