Well we had our OR interview yesterday, The OR was late, which surprised me, as everyone seems to say they are very punctual, Unfortunately we got the a bit of a snotty OR, who seemed to have a bit of an attitude she did seem a bit condescending and a bit patronising, but we kept our OR survey cards that came with our pack, so will be relaying these feelings.

First the bad news I have lost my car, I valued the car at approx £1800 and she valued it at £3500 which is strange as it only cost me £3300 over a year ago maybe I have the only used car in existence that does not depreciate, she did give us the opportunity to buy the car back but we couldn’t raise that sort of cash, so looks like my dad will be sharing his car, good ol dad. She then wanted me to produce the docs for a car I sold in October of 2005 I purchased said car in 2003 for £3800 and sold it 2 years later for £1900, and she thinks that I sold it for vastly less than it was worth!! The rest of my interview was pretty straight forward but will be expecting a BRO it seems that if you have done anything remotely silly with your money, you will be getting a BRO, but to be honest I really don’t care if they give me one for the rest of my life, I have no intention of getting credit again.

Since our interview we looked online at what people are getting BRO’s for and they are handed out for what I would consider fairly minor infringements, one was handed out because the petitioner was only paying min payments on their credit cards the insolvency service argued that they would not be able to service the debt as interest rose. So if you are going to go bankrupt in the jurisdiction of cambs county court be aware that you need a bloody good reason to hang on to your car and be prepared for a BRO if you have been even the slightest bit irresponsible with your credit.

My partners interview was a quick 25 mins, she was asked about her life insurance policy and told that she can buy it back from the OR for £50 which we will probably do, it has no surrender value so the OR has minimal interest in it, she was quizzed about the maintenance payment she receives and asked to produce a letter from the CSA, my partner explained that the CSA was not interested as it was an amicable agreement between her and her ex and the CSA just set the amount the agreement was made 10 years ago, however the OR still insisted that she needed a letter from the CSA, so don’t know how we are supposed to conjure up this letter but we have written to her explaining once again that there was no CSA letter as they were happy with the arrangement, perhaps she will understand it in writing rather than us explaining. The examiner we spoke to seemed to be a bit unprofessional although she had all our paperwork in front of her as did we it seemed like it was the first time she had seen it, at one time asking us about houses and addresses we have never heard of weather this was designed to try and make us slip up I don’t know, but we didn’t leave our interviews with a comfortable feeling and that’s for sure.


Having said that I do not wish to scare anyone off if you have been advised that bankruptcy is your best option then please go for it¸ although our experience with the OR has not been great (Our day in court could not have gone better) it is certainly preferable to being harassed by creditors, I think the best way of looking at it is a bit of short term pain for long term gain, we have a clean slate and a fresh start without the omen of debt hanging over our heads, and that you cant put a price tag on. The pro’s far outweigh the cons.

Well still no word from the OR about keeping the car or not. Alliance and Leicester bank account is still active,(the only one closed is our co-op current account but I closed that when I told co-op we were bankrupt and opened our cashminder account) and the only creditors that have been told of our bankruptcy are the ones we have told (sent a letter and a copy of bankruptcy cert as they were hassling us) but low and behold lloyds Tsb have ignored it and today I received 2 default notices!! The only creditor that has acknowledged the letter we sent is Goldfish.


I know its only just over a month and there isnt a lot the creditors can do but still stressful getting these letters. The OR said a month ago that she is snowed under, (she even double booked our OR phone interview!) and to send her any letters we didnt want to deal with, which we did, and she would deal with them, which she cannot be doing. Grrrrrrrrrrr!!

  • A bit different to my interview today where the OR said i could buy my bike back at auction value (approx 50% of market value) and also keep my van worth maybe £1500 and he was quite happy with the valuations i sent through from wisebuyers website.

    I would do some investigating as to the value of your vehicle and also find out how they would sell it because if it goes to auction it wont be anywhere as near as your OR says. maybe you caught her at the wrong time of the month

    Well my 6 years are now up, now to start to rebuild my life again

  • Hi empty wallet, I got my valuation from wisebuyer too, she initialy accepted the valuation of £1800 and said i could buy my car back at £1500, she then rang back 10 mins later and said that Parkers guide says its worth £3500 which was utter rubbish as i checked them too and they were saying about the same as wisebuyer, so dont think she was looking at the right year or model.

    Dont know if you or anyone out there knows, can I appeal against the decision to take my car, the reason i was given for losing it was, as I am unemployed I dont need it, the trouble is I live in a village in the middle of nowwhere and without a car I will really struggle to get work, public transport is truley pathetic around here.

    What make, model, reg, year etc is your car (you can PM it if you want) and i will see if i can look in the Glass's price guide (what car/bike dealers use) at work tomorrow for you as i need to check out my bike value anyway (i think the guide we have shows cars aswell as bikes). From my experience Parkers price guide is not very accurate, they seem to under value vehicles quite a bit. I found wisebuyers to be virtually on the nail for prices for my bike when i got it and as it is now, you could also go on autotraders website and find similar cars to yours and see what price people are asking for them.

    Maybe your OR has looked at the full retail value from a franchised dealer for your car and not private/auction value.

    Just a thought.Why don't you send a up to date bus timetable of your area, with your route(for work ect) highlighted and a covering letter explaining about the valuations on the car and your need to keep it.Must be worth a try.Dalip

    The thing is I was made unemployed a couple of months ago and because I'm currently unemployed she says we dont need a car. Trouble is when I find work it is likely to be at least an hours journey as there is precious little work here in our village, Ive always had to travel over an hour away when ive been in work. As our children have an genetic condition they have appointments at Addenbrokes often and the bus service there is awful, having a car is more of a need then a want but our OR is insistant that as I dont work at the minute the car is going ;(

    So fight it!!! Come on your kids need that car.If need be ask for another OR to review it. Just write it all down, no matter how long winded,included all the details of hosp app ect,timetables and hope for the best.You have nothing to loose and all to gain by trying.Dont stop fighting now you have come so far.Dalip

  • It almost sounds like your OR doesn't want you to find work, as no transport no work and its not like you would have the money to buy a vehicle if you do find work.
    Unfortunately it sounds like you have a bad OR. i thought i would lose my vehicle as i have access to another car (my OH's) but he was quite happy for me to keep it.
    Maybe you should remind her that your paying her wages and your basically paying her for a service that your not really receiving, the least she should do is send you details of how she came to the value of your car.

  • You are right Dalip, it is worth a go, we will draft up a letter today ( not worth ringing as she never seems to be at work when we have tried to contact her) Going to keep our fingers crossed, like you said our kids need that car. Thanks again for your advice
