Theres rather a lot of us at the moment headed courtwards to getting our deposits back from landlords. Some of us feel great frustration and trepidation of the court services.
I wondered whether we should all share stories and get our heads together to get monseysavers thier money back
So, who is in that same boat as we are....

I'm not in the same position as you, but I'm happy to help or be a shoulder to cry on/vent at.
Don't be frightened of the courts - it's such a buzz being in there. I'm always disappointed when someone settles before court.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

I'm not but wish you well. My last tenant had his deposit returned in full - 3 weeks before he moved out.
The ones before left owing rent, with the house in a right mess. They never asked for their deposit.
I hope the new tenancy deposit rules make a difference and that problems like this can soon be a thing of the past.

My landlord is stalling giving back our deposit - basically we're only losing £60 of it, but he is delaying giving back the remaining £1100 (gulp) by being unavailable when the letting agent tries to call him to get him to confirm she can release the money.
VERY VERY ANNOYING - he's been stalling for about two weeks now. Doesn't seem like a long time but me and my OH can't afford to be £1100 out of pocket, especially as we've had to stump up the deposit on our new place too.
It seems to be a consistent experience every time I move flats - landlords are so reluctant to give up that money that isn't even legally theirs!! :rolleyes:0 -

Why dont you serve your letter before action? Make sure though you serve it to the right person.
Im in a dilemma as to how to proceed myself as it goes.
basically when I went to sigh up for the place, I could only draw out 500 in cash ( plus what i could get out of ATMS) over the counter. So I had to pay over 2 days. The first time I paid X amount and the next time I paid x amount. The figure should have been one months rent upfront & one months deposit. So 758*2 =1516. I paid, it seems 210 too much. Some of this, I think was supposed to be for the credit check- but that was only 50 quid only for me, however, I never returned the forms to them and still have them. Therefore they cant have done the credit check on me anyway.
I had written to them about it ( the LA) and the LA claimed a totally different fiugure was given and that it was correct. However, I have the recipts so sent a copy of the reciepts with a letter saying that we had over paid ( pls see recipts) could they please forward the 205 by this date. They havent replied.
I dont have the LLs address. tjhe LA has never given it to me, and im fairly certain they wont give it me now!
I am not in the TDS as my rental started in Jan 07, before it came in.
Additionally, I went in 2 days before we were due to hand the keys in to collect straggling post ( we moved out a week before & told the LA we were going and she could start viewings right away) to find that there was painting equip there, ladders etc, and one of our neighbours said that they were doing a proper refurb ( fair dos, it needed it!)
What I wonder is that if the LA/LL say that we had not left it in XYZ condition when we moved out? But they had started painting before the a) end of AST and b) before Id given our keys back.
We had no inventory.
I was working as an inventory clerk at the time and noted everything
I took loads of photos when we moved in
the place was a hole, including dead mice under the stairs :eek: and rotten food throughout in carrier bags
the property was literally filthy - the oven :eek:
However, we cleaned it ourselves didnt complain so that if they paid a contract cleaner to do it then wed have to pay one when we ledft so we jsut did it ourselves.
I am ready to do my LBA, but not sure who to address it to, I expect the LL, burt if I dont have an address.....maybe i'll email the LA now and see if she replies ( cant see it)

What a fab idea Lynz .... I'll join .... Here is my thread here if anyone would like a read ...http://forums.moneysavingexpert.com/showthread.html?t=739595 ... In a nutshell, The Wicked Ex-LL of The West has kept nearly all my deposit saying I have ruined her oven and hob (by cleaning). The LBA was sent Friday ... not heard anything back yet so I imagine she has seeked legal advice to try and wriggle out of failing her statutory duty by not protecting my
deposit ...

The solicitor I consulted and who sent the LBA said that I was entitled to the x 3 penalty ... The law seems quite clear in what the court must do but I worry my ex-LL will get away with it by saying that she didnt know about it and that if she did she would have complied .... :rolleyes:
I'd be interested to know if any LL's have been penalised yet via the courts for failing to protect deposits ..:happylove Tori Bellatrix :happylove
