Hello there can anyone advise me of best course of action? I have sent my first letter stated charges etc and asking for them back. norwich and Peterborough Building Society have replied denying the charges are unlawful and
[I]"we have simply enforced the advertised charge structure, to which you agreed when entering into the contract with Norwich and Peterborough Building Society (the application form you signed on opening your account included a declaration and agreement which stated that you have read and agreed to be bound by the conditions of the account).[/I]
Are they just trying to scare me into giving up or do they have a point?

Personally I reckon they are just tying to scare you, You can send a further letter or threaten to take them to court, its worth a try isn't it. Surely if what they are saying is correct then all of us who have bank accounts would be bound by the conditions.0

Just start a small courts claim as per Martin's article. That will get your costs back0

Yes, you agreed to those terms and conditions in good faith that they were legally fair but unfortunately have since found out that this is not the case. A contract must be fair within the law and they can't enforce a legally dubious contract.I've been lucky, I'll be lucky again. ~ Bette Davis0

It sounds like the normal bumpf they are sending out these days.
I can only state my experience so I don't want to give people the idea that this is the way things go but if it helps...
I asked for all my statements going back 6 years (cost £10) took under 14 days................but I did phone them...calculated the cost..sent 1st letter..but I went through (https://www.bankcharges.info which I think was a Scottish website) sent my first letter In June /July (Halifax Bank by the way).... Debt was £460 but they offered me £70...I said no..2nd letter a few weeks after..they threatened to close my account...luckily i had already changed my bank due to said issues so made me laugh that one...I sent another letter back threatening court action..they again stalled and then offered £200.....I said no..and sent a third letter not on the template but written by myself...they again reiterated their position etc etc............again i said no...i was willing to go halfway at this point but they gave me no choice..so within 14 days i filed a claim at the court which cost me £80 ( at this point it was the principle).
They replied with a defence letter saying they would defend it in court ( liars, thats a stalling technique, they hope you will crap yourself at this point and pull out. i just thought oh !!!!!!...never mind at least it will be interesting.
Within 7 days i recieved a letter saying thay would pay full costs ( debt, court fees and interest ( which i had calculated at £120ish) if I took the matter no further.............and I still have the account.........I held out and won..my sister got 50% back but she wasn't willing to take it further.....
Yet you don't want to be the one to make a precedent, the decision is yours....do what you feel is right for your circumstances at this time.
Ps. I phoned them every time i sent a letter just to make sure they got it..don't be afraid to hound them... you have a right!
PPS I know it sounds stupid but do read the templates you send them, it does help you if you have some idea of why you are doing it ( sorry don't mean to be patronising)

Hello all
Sent off for all my statements, sent the first letter asking for the payments back and hey presto! Letter recieved saying they will pay back 100 % of the charges, they won't close my account but if I claim again they will reasses the situation. I didn't even have to send the LBA ! My claim was for a small amount, don't know if thats why it got sorted so easily. all in all took 4 weeks, so anybody else thinking of doing it...GO FOR IT !!!

hi georgeyoggy, was well pleased to read of your result with the norwich &peterborough, i am also banking there, i`ve been there about 14 years, and in the last six years have been hit with these bank charges 4 times, my main question is whether it is wise to ask the dates before i proceed with the reclaiming, mind you since reading your letter, i think that it would be better to do as you did and give them the first letter, and keep my fingers crossed, can i ask you if you knew the dates of your claim before you submitted the first letter? any advice would be most appreciated, once again nice one. my regards, roonies.0

I don't quite understand your question about knowing dates etc but the OP did their claim by following the steps in Martin's article linked below, these are tried and tested and work.
