I can't take it any more :( :(

Please can someone help me, I feel like I'm at the end of my tether.

As some of you might be aware my hubby and I between us have about 60k worth of debt (not incl mortgage). We've been trying desperately to get everything in order to pay this off through snowballing etc. It's been going relatively well but everytime I think I'm going to be able to start paying off extra, something comes up to bite us, usually from the past.

A few months back it was overpayment of child tax credits. Before that it was council tax rates from when hubby had the pub back in 2002. Now I opened a letter today addressed to him, thinking it was to do with the child tax stuff, and find out he owes 4.5k from rates back then. We have a week to pay otherwise the bailiffs visit.

I can't do this any more.

I've been trying to feed 5 of us on a tenner a week. I've failed. I've been proud to have done it on 20, but I still failed. I can't cut back any more. It's just not possible.

Without buying any food or gas or electricity I'm already 50 quid short next month. My new(ish) car that I bought so I could sell the other one and use the surplus to pay bills with has died.

I want to look at bankruptcy. Please can someone answer me some questions.

1) We've only had our mortgage since April 2006. I'm guessing the house won't be seized because of the lack of equity.
2) I've just got a new job as a member of police staff which I absolutely love. Will I have to declare this to them? Will it make a difference. I'm obviously still in my probationary period. I'm scared I'll lose my dream job.
3) What do I do with the creditors in the mean time?
4) Is there a step by step very simple guide to what to do?
5) Is there a support line?
6) Am I doing the right thing?

:( I'm at work all day wthout internet access but will be checking back this evening.

    is this the first you knew of the rate debt seems odd if this is first contact and they are already threatening with baliffs.Your OH needs to check his paperwork from back then to see if he made any payments and when ,contact the council involved and make an appointment to see them and discuss the problem and possible solutions and ask them to delay further action until after this meeting has taken place you say youve already had problems with council tax rates from the pub so what rates are these are you being pesued for the same thing twice by different departments?

    The would obviously be a lot of questions you need answering before you can decide whether BR is for you.. mainly due to the house issue.. If the property is in negative equity then the OR may not touch the house or allow a third party to buy out the beneficial interest for a token payment.. However, im not too well versed on BR when property is owed..

    Without stepping on toes, and acknowledging what an excellent site this is, I would recommend you registering on DHUK forum...

    I am a moderator on that site and we have a fantastic member called brin, who is an insolvency practitioner... if you posted a message on that site, brin would go through the whole scenario with you, so that you were then able to make an informed decision...

    I admit that I know next to nothing about the processes of bankruptcy, but given that you are trying to feed your family on an impossibly small amount it does seem like a sensible idea to at least look at it.

    Whether or not the Police will take a dim view of your bankruptcy is something that you should discuss with either a union rep or the HR department. Clearly if you do go down the bankruptcy route it is not something you are going to be able to do without considering your position at work.

    Try re-posting your questions on the new Bankruptcy board - that's what it is there for! :)

  • Hi Brassic, I can't offer any advice, but would suggest the Bankruptcy board. I'm sure some of the chaps and chapesses will have lots of advice for you.

  • Sorry read post too fast... you cannot go BR - as far as I know IF you are oin the police force... It looks like you need to consider an IVA... go on the above website I mentioned though, cos brin will definately be able to tell you if BR is barred to Police Officers... im 95% sure that it is though..

    Hi Brassic, I know how you feel - always chasing your tail, one step forward and at least one back again etc etc.

    Perhaps IVA or a DMP may be a better route for you. I am fairly sure that even civvies in the police cannot be bankrupt but someone will be able to answer that for you I am sure.

    How about giving payplan or CCCS a call - even though we decided to go down the snowball route, payplan were happy to talk to us and to allow us to look at all the options without any pressure.

    Main thing to remember is that you are not a failure. You have made a remarkable amount of progress and you should feel very proud of yourself. Whatever happens from now on, at least you are doing your very best and no one can ask any more of you.

    I can't offer any advice on your bankruptcy questions - but I wanted to offer a word of support.

    Look at your sig. You've paid off £5k since june last year. That's something you should be proud off.
  • Aww big hugs. :grouphug: I don't know anything about bankruptcy but clearly you need to see an advisor as you shouldn't have to live off £10 a week for food for 5 of you. Hope things get better for you soon.
