Problems with a buyer

I sold a VAX carpet washer about 2 weeks ago, by the time cheque came and cleared (extra day due to bank holiday) it was Wednesday just gone. So I arranged for DHL to collect it the next day on a 48 hour delivery.
It was used once and in perfect condition we checked it throughly as wed had problems with the buyer getting funny via phone and text over his mortgage bouncing so we had a feeling this would be trouble.
It was sent in the same packaging that we had used to send our old one back to VAX in twice and they had returned it to me in twice, its a strong plastic bag that came from VAX and went through DHL. same courier who delivered it for me.
Buyer rang me an hour ago very angry saying the dirty water tanks missing, packaging was open and the plastic spray was cracked and twisted and the brushes unscrewed. Now its hard plastic so wouldnt twist!
Hes sent me photos and I can see the brushes have been unscrewed but by him or DHL?
Apparently the driver pointed out to him on delivery it was open, so why did he not refuse delivery?
Ive rang my local depot it was sent straight out to his depot the day it got back to mine after collecting and the driver who collected it said there was no damage done and the parts arent at my depot or on his van.
So I rang his receiving depot as per my tracking, they too have no parts there that have fallen out, have no record of it being damaged or opened (apparently they seal with DHL tape if its open but buyer says there was none on there). Im waiting for them to check with the delivering driver and ring me back to see if he did point out the damage
Im not sure what to do as I cant see DHL opening it, removing these parts including unscrewing the brushes
Im a bit worried as hes been quite nasty on the phone and only lives about an hr and half away and did say on the phone before he would be coming down

Am I reading that correctly you posted this expensive sounding VAX machine in a "perfect/virtually new" condition but with nothing but a plastic bag for packaging/protection?0

What was wrong with the old one that it had to be sent back twice, and why buy a new one, use it once, then sell it?
You need to speak to the driver who handed it over to the buyer, and confirm that he told the buyer it was open.
Personally I would write to the buyer saying that as they signed for it, depsite apparently being told it was open, they've now accepted the goods.
Given they paid by cheque, there's not a lot they can do other than leave you a neg.Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0 -
My old one sent to and from VAX in this machine several times and no damage done so I assumed it would be ok
The old one was faulty so I sent it back and they replaced it with a new one, we no longer have carpets so no longer use it. But this isnt the issue as I can sell an item for whatever reason I choose?
The driver has confirmed twice they told the buyer the packaging was torn at the bottom but he said it was small hole nothing could have fallen out and there were no parts on his van.
Also the parts missing would mean the VAX would be removed from the packging and the tank unclipped and the brushes unscrewed from the bottom, then it put back in the packaging and resealed.
The driver also said the receiver told him he would still sign for it as its an ongoing thing, but he wont tell me what that meansWins so far this year: Mum to be bath set, follow me Domino Dog, Vital baby feeding set, Spiderman goody bag, free pack of Kiplings cakes, £15 love to shop voucher, HTC Desire, Olive oil cooking spray, Original Source Strawberry Shower Gel, Garnier skin care hamper, Marc Jacobs fragrance.0 -
Hi
what does the buyer want out of it?? does he want a refund and keep the item, or money back as compensation??0 -
I dont know hes not said.
He has now said the front of the machine was hanging out of the parcel which is why the brushes and tank are missing but the driver insists it was a small hole and nothing was missing. the buyer said the driver would not of seen the missing parts but even so clearly the buyer did so like DHL have said why did he sign for it? Im getting such a headache as I cant for one minute see how it has happened.
Conveniently the packaging how now been cut up so I cant ev en see the holeWins so far this year: Mum to be bath set, follow me Domino Dog, Vital baby feeding set, Spiderman goody bag, free pack of Kiplings cakes, £15 love to shop voucher, HTC Desire, Olive oil cooking spray, Original Source Strawberry Shower Gel, Garnier skin care hamper, Marc Jacobs fragrance.0 -
Could you get the DHL driver to write a statement saying that it had a very small hole which he notified the buyer about twice, and the buyer still signed for it?Should've = Should HAVE (not 'of')

DHL got quite funny with me after the third phone call as they think I am accusing them of unpackaging, removing the part then resealin it which I was not Im just trying to understand what the driver saw and said on delivery.
The buyer wants me to refund him which I cant afford as i used the money towards a new washing machine as I didnt expect all this to happen. I have offered to replace the parts although I cant afford to and dont feel I should as I dont beleive him at allWins so far this year: Mum to be bath set, follow me Domino Dog, Vital baby feeding set, Spiderman goody bag, free pack of Kiplings cakes, £15 love to shop voucher, HTC Desire, Olive oil cooking spray, Original Source Strawberry Shower Gel, Garnier skin care hamper, Marc Jacobs fragrance.0 -
it sounds like hes just changed his mind? I'm sure not many people would sign for something when it appears so damaged. Why doesn't he claim off DHL? that way they could fight it out between themselves?
perhaps he needed all the things (Brushes, dirty water tank) that are missing as spare parts for his own and now he's got them wants to send it back for a refund
I think whatever you do , he will leave a neg as sounds like a nightmare!0 -

Why should the buyer claim. Its up to the seller. It just sounds to me like it was sent poorly packaged, in a plastic bag! (I dont care how strong it was a plastic bag when it should have been in a box)
I have signed for things that the packaging was damaged before only later realise the items were damaged, which is why when I sign now I put not checked by it and condition of packaging0
