    Two separate issues…….

One is you must have a valid MOT and I’m not aware of any mechanism for removing or shortening the life of one once it has been issued.

Two is driving a roadworthy vehicle, this is purely a matter of fact and the absence or possession of an MOT (even if issued 10 mins ago) has no bearing.

Obviously the MOT database records fails even if the car still has a current MOT, whether this shows up when the police/ANPR do a check I don’t know. It probably just says MOT or no MOT as lack of MOT is not a serious offence in the general scheme of things

??? But you must admit? the failure of an mot 11 months after a pass must overide the pass?

This is a bit like the driving hours law scinerio quandry, you could live in Scotland, drive down to London visit a relative, have your car MOTeD whilst there and it has just enough tread to get through without an advisory, but by the time you get back to Scotland the tread is below the requirment. The same applies to driving laws quandry, you live in Scotland, but work in London, you can drive down from Scotland, do your days work, return home and as long as you have only done permitted hours at work you have done no wrong. So wether its 10 mins or 11 months after the MOT, I would suggest that when a car passes its MOT without any advisorys, the tester is saying that it is at least road worthy for the next 12 months. Me personally i take my car for a MOT 1 month early as if there are any faults i have 1 month to fix them, if not i have 1 months extra MOT

As long as youproduce the previous MOT certificate they will run the new certificate from when the last one run out, ie present MOT runs out 2/9/09 you take car 3/8/09, as long as you produce present certificate they will date it from 2/9/09 and staple present certificate to it

As with anything else to do with the DVLA, there is a thin blue line ie, you pass your test on Tuesday but on the Wednesday you hit the kerb doing a 3 point turn, should you have you license revolked if the police see you????

Obviousley if it passes but as i say, you take it a month early to avoid having no vehicle until you can afford to put it back on the road

You don't have to take old cert. They get date of expiry from database.

The staple you mention isn't a regulation, and not compulsory for the garage to insert one into your certificate. (Just in case anyone feels cheated if they aren't given one).
