HAPLESS PASSENGERS IN BENDY BUSES ARE CRIMINALISED AND FINED VARIOUSLY £260, £460, £10,000, DEPENDING ON WHETHER THEY APPEAL THE INITIAL CONVICTION. THE PROSECUTION IS BROUGHT BY LONDON FOR TRANSPORT IRRESPECTIVE OF THE AMBIGUITY IN TWO PROVISIONS OF THE PUBLIC TRANSPORT REGULATIONS 7(2) AND 7(4). THE LATTER STATES THAT A PASSENGER HAS NOT EVADED THE FARE UNTIL HE STEPS OUT OF THE BUS. BUT TFL IS CONFISCATING OYSTER CARD AND PROSECUTING PASSENGERS WHO ARE INSIDE THE BUS.
THE LAW SAYS THAT A PERSON CANNOT BE CONVICTED WHEN A LEGISLATION IS AMBIGUOUS, BUT THE COURTS HAVE IGNORED THIS ASPECT OF CASE LAW. mOREOVER, UNDER A LEGISLATION CALLED CRIMINAL INVESTIGATION AND PROSECUTION ACT, A PROSECUTING AUTHORITY, I.E. TFL, IN THIS CASE, HAS AN OBLIGATION TO INFORM THE COURT OF ANY INFORMATION WHICH WOULD UNDERMINE THE CASE FOR THE PROSECUTION. TFL CONVENIENTLY FLOUTS THE LAW AND REFUSES TO DISCLOSE THIS INFORMATION TO THE COURT. UNFORTUNATELY, IN SOME CASES, THE JUDGES ARE COLLUDING WITH TFL TO BREAK THE LAW AS THEY ALSO IGNORE THIS LEGISLATION.
SO, TFL HAS BEEN PROSECUTING PASSENGERS FOR FAILURE TO SWIPE THEIR CARDS AND REAPING ILL-GOTTEN GAINS IN THE PROCESS. SO AN UNPAID FARE OF 80P OR £1.20 FOR NON-OYSTER CARD HOLDER COULD LAND A PASSENGER IN FRONT OF THE BENCH, A HEFTY DENT IN HIS POCKET, AND A RECORD TO BOOT.
TFL IS SO DETERMINED TO GAIN CONVICTION ON THE PRETEXT OF REVENUE PROTECTION THAT IT IS PREPARED TO PERVERT THE COURSE OF JUSTICE BY
1. DOCTORED EVIDENCE
2. DECEIT THAT ONE DAY TRAVEL FARE IS NOT AVAILABLE ON OYSTER WHEN IT IS READILY AVAILABLE.
3. IGNORING THE FAULT ON THE CARD, THAT IS, FAILURE TO CAP. IN ONE CASE THE CARD SHOWED A CREDIT OF 90P WHEN THE REAL AMOUNT WAS £4.70, WHICH WAS EQUIVALENT OF ONE DAY TRAVEL FARE. TFL IGNORED THIS FAULT AND WENT AHEAD WITH THE PROSECUTION. NEEDLESS TO SAY THAT IT WAS A CASE THAT THE CONVICTION WAS GAINED BY DECEIT.
PLEASE, MARTIN AND OTHER MEMBERS OF THE FORUM, LET US GET A CAMPAIGN OFF THE GROUND TO OVERTURN THESE CONVICTIONS, GET COMPENSATION FOR THE MISCARRIAGE OF JUSTICE AND ENSURE THAT THE POLICY THAT FULL FARE IS CHARGEABLE FOR FAILURE TO SWIPE THE CARD ON TUBES AND DLR IS EXTENDED TO BUSES.
TFL'S CURRENT POLICY IS A REAP OFF AND WORST THAN THE BANK CHARGES POLICY.

Come to think of it, last time I got on a bus, they CLOSED the doors and DROVE OFF without my explicit consent. When I asked to stop I was told NO! not until Primrose Gardens.
Isn't this UNLAWFUL IMPRISONMENT? I think we should be told.Says James, in my opinion, there's nothing in this world

Funny, when I try and get on a bus they normally try to close the doors before I get on............0 -

I guess I am too in this case. Last time I ventured to that filthy midden of a city called London was in 1996. Thanks to Red Ken, hordes of criminals marauding around the metropolis, and the danger of being robbed, overcharged, conned and ripped off, I don't intend to go any time soon.:D0 -
