kind of spoils the idea of moneysaving for all on the forum doesnt it?
Thank you, for this reason, I have decided not to post some bargains on GRABBIT, because in the end it spoils it for the rest of us....

If it is a genuine sale price then calling customer services makes no difference at all, there is nothing to flag up. The poster didn't order 1200 they added that many to their basket to see if it showed a stock level. I do this sometimes with sites, usually only 99 though. If there is limited stock the site will usually tell you how many are available to order.

I didn't order anything, but agree with Toto about stock checking, as opposed to actually placing an order. It's a well known trick on other sites (Boots.com springs to mind) - in order to check stock levels add 99 or 999 etc to the basket and many sites return the actual number left in stock with a message to state that stock levels are insufficient to meet your requirements. Of course, you then just empty the basket, or amend to the amount you really want (usually just one;)).

So I don't think anyone actually ordered, or intended ordering 1200
  • Off of the B&Q site:
B&Q cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive the e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.

Its the last bit they will use to back out of the deal if its a mistake!
A bargain is only a bargain if you intended on buying it in the first place!!!

I agree Im sure this was actually what he meant.. and was meaning to say that people shouldnt get too excited here as they have probably sold 100s more than they actually had..

And lets face it, how many others have called them but not posted the fact.

A sweeping, unilateral exclusion clause like that is the most blatant breach of the Unfair Terms in Contracts Act (and the Unfair Terms in Consumer Contracts Regulations 1999) you'll ever come across.

In the one breath they're saying a binding contract exists upon their acceptance, then in the next breath they're saying "oh, but we refuse to be bound by any contract". :rotfl:

If you've had the confirmation e-mail then acceptance has taken place and winning this one in court will be a breeze.

Many well known stores have taken my money and then e-mailed to say 'sorry the item is out of stock' and then refunded the money back to my account. If the store hasn't got them how are they physically expected to honour the agreement?

I am no legal expert but surely the agreement can be rescinded where the goods cannot be supplied. However, if they have taken the money, are able to supply them but find they have charged/advertised incorrectly and refuse to supply because of this, I think then there should an be arguement in favour of the consumer. Just my thoughts really!
