I will try and dig out the reading I've been doing and the somewhat loosely interpreted clauses I have found. I am not at home at the moment, but I will be home Friday and I will have a look then.

    To Pink Fairy:

Write them a letter first explaining that their charges are illegal and if they do not return the money to you in full within 7 days then you will start legal proceedings for recovery.

I have a couple of useful web sites that may interest you, but as per the forum rules I'm not allowed to post them here.
PM me for the links. Unless someone here who isn't associated with the sites can post them for me ;-)

    Will these help?

I bought a car from Fiat in 2000 using their 0% interest over 5 years.I went into rehab the following year and missed a few payments - incurring lots of charges.I later paid off the loan plus charges from the sale of my flat. Can I claim back these charges as I used Fiats finance, not a credit card?
    Thanks.
  • Good Morning Everybody!

And for once, I mean Good Morning!!!!

Delighted to post this morning that I have just gone on line and checked my bank account, only to find a credit showing - adjustment commission £1331.50.

The Co-op have paid in full without going to court on the basis of three letters.

Please any doubters take heed, these charges are illegal and will be refunded if challenged. You have to show the bank you are serious and won't capitulate.

Many thanks dchurch, I could not have done it without you!!!!

Lets all get on the banks backs and get these charges dropped once and for all.

    Result!!

suffolkb: The same rule applies - contracts are contracts and thus bound by the same contract law.

inmypokcetnottheirs: Excellent news - well done!! Persistence pays off; again!!

I would rather not go into too much detail "embarassing" but my wife managed to run up an overdraft with Natwest to the tune of £2600. Last week I went into the branch and asked to speak with the manager and was obliged.

The manager & myself went through the account and I noted that only £580 of payments had been honoured meaning £2020 of the overdraft was made up of bank chanrges. I offerred him £780 in full & final settlement of the debt and he laughed (literrally). I spent the next two minutes explaining to him about the student whom had taken his bank to court & the reasons behind the students action, I also explained to him about this thread here at MSE and that I was leaving the bank and would start legal proceedings in the form described in this thread.

Without question the manager accepted £780 in full & final settlement of the debt.

I really didnt think it would be as easy as a 25 minute conversation but it was, so thankyou.

You're welcome, they are an inspiration to myself at the mo and shall be challenging LloydsTsb very soon :D I am angry enough not to back down, firstly though i am dealing with my sons charge through Halifax for a late payment fee for which they did absolutely no administration
