DVD SOON CANADA Please help !!!

 Please please is there anyone out there who can give me some advice on my legal rights re trying to get a refund out of DVDSoon in Canada? Basically 3 months ago I put in a order total value $77 which they never completed so as it took so long I cancelled the order and tried to claim back my money (they state that it is part of their contract that refunds can be made on cancellations). Anyway they have removed the refund form from their site, I have written 15 emails asking, begging and practically screaming for my money back. Just now received my one and only reply from them stating the following:

Our apologies for the confusion. As of July 20th the refund form on our website has been temporarily removed. Our development department is currently revamping this process to make it faster to be completed. Presently the turn around for this process to be completed is 3 weeks. Unfortunately the new process has not yet been explained to use here in customer service so I do ask that you check back with us in three weeks so that the new procedure may be explained in full. I apologize for the inconvenience.

I have written back saying I feel this is dam right not good enough and I feel they are holding me to ransom over my money. I just want it back, the dvds were for presents for birthdays which have now come and gone and I've already spent out more money replacing the dvds in the UK. I've been a customer of DVDSoon for over a year and never had probs with them before but now they just seem to have gone bad. Please does anyone have any legal standings I can throw at them, or advice of whom I could contact in Canada to give them a kick up the a**e etc. Sigh sorry to nag on but I am at the end of my tether, also sorry if posted in wrong place I am STILL not used to the new site, old dogs find new tricks hard

If you paid on a credit card contact the CC company and ask them for a refund on the basis you have not received goods you paid for.

The CC company may try to argue with you but be firm with them.

Also do a Google search on DVDsoon as there appears to be some mumblings around the way they are currently acting as several people have experiencing problems getting refunds:

I'd suggest getting hold of your credit card company urgently

That website just looks to be a much smaller site similair to MSE?

The suggestions on all the DVD boards found via a Google search is to give up trying to contact DVDsoon about a refund and go straight to your credit card company.

Hi guys sorry didn't answer all replies earlier but been so busy. Many thanks for the suggestions, I will have to get onto the bank tomorrow then, I don't know if debit cards have the same protection as credit cards so I will have to try and see what happens, I know I can't afford to lose the money thanks again guys

this was posted in the DVD Times forums yesterday (sorry, don't know how to do links) it would seem you're not the only one having problems TaBunny :(
can't imagine what they're thinking, I used to get dvds from them a lot (a few years ago when I was better-off) & had no trouble at all. they're certainly not going to do themselves any favours with such appalling service!

Eagle-eyed readers may have noticed that we have removed all links to Canadian retailler DVD Soon from the site. Unfortunately we feel we can no longer recommend DVD Soon as a retail source due to very bad customer service, the cancellation of orders and the companies new policy not to refund customer's credit cards when an order is cancelled by the company.

It now appears DVD Soon has very little stock and the vast majority of titles ordered are not shipped - this is also the case with many preorders which immediately switch to 'On Order' on the release date. It is apparent that DVD Soon are no longer able to source stock of most major releases.

If you are a DVD Soon customer with titles on order, we'd recommend you contact your credit card issuer to explain the situation. They may be able to advise you of the best way to recover any money that has already been charged but without any product being supplied. It is also worth keeping an eye on this thread on The DVD Forums for the latest information from DVD Soon customers

here's the URL for that thread if anyone's interested http://www.dvdtimes.co.uk/content.php?contentid=58194

oh! an automatic link-maker, duh :o
  • I'm in a similar situation. I've cancelled one order and they will only give a store credit for it. The store credit can now only be used to pay 25% of your new order. The credit can not be used to pay shipping charges so that is an additional charge. I also have an item on pre-order which I don't think I can do much about until the release date passes.
Most of Dvdsoons customers seem to have had their existing orders cancelled by the company and surprise, surprise they've put the prices up . At the moment I can't even get into my account to check what is going on since it's been locked since Sunday. I contacted Dvdsoon who suggested things like clearing cookies etc. When that didn't work they said to leave it 24 hours. I'l be trying again this afternoon to get in.
PS The locked account thing is a bit weird as I was putting in the correct username & password.
Sorry I can't be of any further help. Just thought I'd let you know you're not the only one.

Speedy - only found out about this today and was disgusted too. Having read up about whats gone on one of the DVD Forums I've done what everybody else has and initiated a "charge back" with my credit card company "Mint". They're sending me a form to fill in and send back. I think this is because its Mastercard. People with Visa cards seem to be getting them reimbursed immeditately over the phone. This is also applicable if you paid by debit card that is a Visa or Mastercard one.

I suggest you look at your card statements for any outstanding transactions and contact your card provider.
