    Dear Premier Park Limited,

    Thank you for your latest threatogram. I confirm that you will not be receiving a penny from me. Should you be foolish enough to bring an action in this matter I will of course draw the court's attention to your unreasonable behaviour in failing to follow the correct procedure with respect to the ADR service PoPLA and your nonsensical excuse for your omissions, and I will be requesting my full costs.

    Finally received the Witness Statement today... direct from the BPA AOS team! PPL claim they posted it on the 15th March by 2nd class post. Convenient that Royal Mail failed to deliver it. :rotfl:

    Anyway, it is crap. The metadata shows it was created by the Director of PPL. It manages to mangle landowner and land agent in an effort to obfuscate the reality. It is signed by someone, who, as far as I can find, does not exist. Now that I have something to hang PPL with, I have emailed the Landowner to ask them to confirm the identity of the signatory and demonstrate that he has authority to issue the witness statement.

    Oh... and I asked them to cancel the ticket. :A

    Did I mention that I am having fun with this now???

    Well... the landowner has been really helpful with my request for them to confirm the identity of the signatory on the witness statement... they have forwarded it to Premier Park Limited. :mad:

    They have also stated that they cannot intervene between me and 'Premier Parking'. Curious... i thought Premier Park Limited ran their carpark, but the person I was dealing with is new in post so I will put that down to a misunderstanding. :(

    However... Silver lining... a new land search has revealed that the address on the witness statement is not that of the car park. :rotfl: Seems a slam-dunk that they do not have the authority at this point!

    I can't wait for the next letter from Premier Park Limited.

    Hi guys... sorry been working away...

    Having looked at my witness statement... it was signed by 'Clive Stevens - Contracts for and on behalf of Southampton City Centre'.

    Time for a letter to Premier Park, POPLA, BPA and ISPA ripping them all apart. Unfortunately I have to work away again next week.

    Oh... and WH have got involved and bumped the costs to £208.

    First draft of letter to WH...

    Dear Scumbags,
    RE: Your reference xxxxxx

    Regarding the above referenced letter dated x June 2016; I deny the debt and have no intention of paying any money demanded by you, your client or the originator and any court proceedings will be vigorously defended.

    Should it be the intention of any party mentioned in your letter to start court proceedings, then you or they must provide a Letter Before Claim which complies with the requirements of the Practice Direction on Pre-action conduct. Please note that a failure and/or refusal to comply with the Practice Direction will result in a complaint being made to the court and an application for a stay of action and costs pursuant to the provisions of paragraph 16 of the Practice Direction on non-compliance and sanctions.

    In conclusion, this charge is disputed and you must now refer this matter back to your client. Other than an acknowledgement of this letter, you must cease and desist all contact with me. If you persist in contacting me, I will report your organisation to the Solicitors Regulation Authority.

    In fact not going to send this letter... I have just looked at the small print and realised its actually just a ZZPS letter with a WH letter head...might just pass it straight to SRA.

    First draft of combined BPA and POPLA letter:

    Dear BPA & POPLA,
    RE: Lots of references xxxxxx

    I write this letter to inform you that Premier Park Limited (PPL) have operated in a manner that undermines all efforts to legitimise the Private Parking industry. As a consumer I have been let down by yourselves as a Industry body and an Ombudsman

    The Witness Statement provided by PPL, which they have used to attempt to legitimise their attempts at extortion, has been signed by a person that either does not exist or certainly does not work for the landowner in this case, and in others. For completeness the signatory is:

    ‘Clive Stevens, Contracts Manager For and on behalf of Some Organisation’

    I have contacted the Landowner (Landowner) and they did not know about the witness statement or who the signatory was. My research has shown that the signatory of the witness statement in this case, ‘Clive Stevens’, also appears to be the signatory of witness statements across a number of carparks operated by PPL, each time for a different organisation. Whilst this could be a coincidence, the previous behaviour of PPL in this case suggests not.

    At every step they have attempted to obfuscate the truth and obstruct the process, even as far as submitting a different evidence pack to myself from the one sent to POPLA. It took multiple interventions by the BPA before I saw this witness statement. It appears that PPL are generating and signing witness statements to project legitimacy in pursuing consumers.

    To the BPA; I must now demand that you sanction Premier Park Limited, order them to rescind the fallacious Parking Charge Notice they issued and suspend all debt recovery actions they are taking against myself.

    To POPLA; I suggest that you immediately initiate a review of all current appeals against Premier Park Limited. It would be particularly pertinent to investigate how many of their witness statements are signed by the above signatory. Whilst this action will not help me, it may prevent any further mistakes being made in other appeals against Premier Park Limited notices.
