PCS car parking charge - company car

Pappa - no their letter states the date it was posted to the lease company - I have used that date to calculate 66 days (it's taken a further month or so to pass through further hands).
Yes I am definately focusing on work, (but ensuring I understand as much as possible about PPC). Scarily yes any fake charge would be paid. If the PPC sent my work a letter today stating I parked somewhere they would just pay it - which just seems wrong.0 -

correct and the introduction of POFa2012 made it a stipulation that the "customer" had
a: an appeal system via the PPC
b: an appeal system via their ATA

Note: whatever the lease contract says is irrelevant ... what matters is what your company's Car Policy says.0

So the plan of action is
1) Inform work that this is an unlawful deduction from your wages and they will need to refund this. This will obviously need to be done tactfully. Your contract only allows them to deduct fines. This is a disputed invoice.
2) Inform work that you in any case have never received the paperwork from the lease company and you dispute that any liability exists because you paid for parking. In any case the amount (£120) is more than that allowed by the parking company code of practice, and is more that that determined in the Supreme Court ParkingEye v Beavis case so is a penalty and an unfair consumer clause, so even had you incurred it, it would be unenforceable.
3) Inform your work that if they get any more of these, they should pass these on to you in the first instance.
If your work want help reclaiming the £150 from the lease company, I would be happy to assist.Hi, we’ve approved your signature. It's awesome. Please email the forum team if you want more praise - MSE ForumTeam0 -

Thanks everyone, really helpful.
I may have to post this on the employment thread but have you any idea if a company can put a clause in an employment contract stating they will pay PPC invoices and deduct from salary thus taking away your right to appeal? I have read the fleet news article and car park Cowboys but can't see anything about this.0 -

I have no idea
but I will be surprised if any company even knows the difference between a fine and an invoice ..... going by what I have read on this forum .....

And I bet your company frequently states that their staff are their most valuable asset?
Yeah, right! :cool:Please note, we are not a legal advice forum. I personally don't get involved in critiquing court case Defences/Witness Statements, so unable to help on that front. Please don't ask. .
I provide only my personal opinion, it is not a legal opinion, it is simply a personal one. I am not a lawyer.
