Emirates not paying for connecting flights

Hi Yazjee,
Emirates have won just about every court case brought against them where there has been a missed connecting flight from Dubai.
Hi Tyzap
Thanks for your advice, I may wait and see how Juni gets on. I sent a private message but am new to this so can't work out how to view messages in my Inbox (duh..)
It was interesting what you said about the delay to Dubai being over 3 hours. Our delay from Newcastle resulted in us being delayed over 3 hours but less than 4 hours to Dubai. Emirates wrote to us to say that as the delay was less than 4 hrs they were prepared to pay the middle rate of compensation (based on flight length Newcastle to Dubai).0 -
This is the relevant part of the regs, taken from Vaubans guide.
As you can see, they are correct in offering you the reduced rate for the 'single' flight to Dubai.
If that is what they have offered, I would accept it now rather than wait, maybe years, to get the full amount, which I personally believe you are due.
It's your choice now, but remember 'a bird in the hand' and all that!
Good luck whatever you decide.
2.2 The amount of compensation due depends upon the length of the journey, as measured by the “Great Circle Method” [see http://www.greatcirclemapper.net]:
- If the flight was less than 1,500km, you are due €250 per passenger;
- If the flight was between 1,500km and 3,500km, you are due €400 per passenger;
- If the flight was over 3,500km, you are due €600 per passenger. This last tier can be reduced by 50% (to €300) if the flight arrived less than four hours late.Please read Vaubans superb guide. To find it Google and then download 'vaubans guide'.0 -
Juni - perhaps you should get help from Bott, if possible. Or at least seek some help from the veterans on this forum, in terms of your staements and court bundle (and emirates defence)
Emirates can't really use their other "won" cases as evidence unless they are from a higher court, since they don't precedent. However if they do use them to sway judge, you will need full copies, provided by emirates.
Hi Jpears
We have a date for our hearing and are representing ourselves we have had three letters from their legal reps with more details of their won cases warning us they will seek costs from us if we don't withdraw our claim.
We will not be withdrawing our case so watch this space0 -
Hi Juni,
Hope you don't mind me hijacking, but have you had your hearing? If so, how did it go?:j PAID VERY, Barclaycard x3, Vanquis, Natwest, O/D, Tesco & MBNA x2 PAID :j LBM 24/07/15 - Original Debt: £0/31010.23 (100% paid) :eek:
Mortgage - £151.316.54 :eek:0 -
Hi Kirsty
We represented ourselves and we won in the court!
Despite Emirates sending a top representative we won the maxium amount of €600 each x4
Happy Days0 -
Very interesting as the same thing happened to us, flight was late leaving Dublin
Although even more confusing, we actually made up the time in the air, and got to Dubai on time, but they had removed us from the flight list and put us on the next flight.
Did get some compensation in the form of airmilesWeight loss challenge, lose 15lb in 6 weeks before Christmas.0 -
Very interesting as the same thing happened to us, flight was late leaving Dublin ...
But it wasn't quite the same thing. For you (and Juni) the cause of your delay was because you left the EU airport late. Kirtsypoos' delay occurred entirely outside of the EU. Some argue that doesn't make a difference, others say it does.
The NWNF lawyers generally think it does, I recall, and won't take these cases on. But here's one that might: https://www.flightdelays.co.uk/blog/2015/1357/emirates-and-the-connecting-flight-argument0 -
Congrats Juni, well done!
Thank you Vauban, I will try contacting flight delays and see what their advice is.:j PAID VERY, Barclaycard x3, Vanquis, Natwest, O/D, Tesco & MBNA x2 PAID :j LBM 24/07/15 - Original Debt: £0/31010.23 (100% paid) :eek:

I would advise you to do it your selves that company recommended lost in their case so I doubt they will take on Emirates again we won in October 2015 in the same court0

Ruthfrench wrote: »Has anyone tried to claim compensation from Emirates and succeeded where a connecting flight in Dubai has been missed? Our first flight left the UK two hours late, we missed our connection and arrived in Sri lanka 18 hours late. The CAA says we have a right to compensation in their view. Emirates says that connecting flights leaving from a non-EU country are not covered. The CAA says they are misinterpreting the rules. We just filed our claim with the small claims court. We got a letter from their solicitor almost immediately inviting us to withdraw from the claim, stating that they have won some similar cases and also threatening that Emirates will pursue us for their legal costs if we lose. Wondering if anyone has successfully taken them on? They obviously only provided us with references for cases they have won in the past!!
Vauban is correct it is highly unlikely they can claim costs from you almost unheard of they are bullying you0
