My neighbour gets DLA lower rate for both care and mobility. His condition has got worse and he needs frequent checks at night. He was told if he applies for an upgrade he risks losing what he gets now if his claim is rejected. I read the rules and believe he is entitled to the higher rate for care. There must be a lot of people who feel they are being bullied into not applying for money they are entitled to.0

hi,i sent a change of circumstances form in on Friday,i live in the north east,i told them I wanted a review on 5th of this month they sent me the form a Dla one and it said I had until 5th November to send it back, can anyone tell me if it will still be looked at as a Dla review or a Pip review please,i don't understand all these changes to the system,sorry if I sound confused I am,thanks0

I have a friend who has just been "threatened" with similar advice from ESA and he was also told he Must Find a Job Now !!
He has very recently had both knees replaced and is finding mobilising himself very painful and difficult,
I believe that these tactics are used on a regular basis and particularly when those concerned have been employed for many years previously and so tend to have a good work ethic and believe in paying their way.
It is time that they began targeting those who are obviously milking the system and not the genuine cases who are easy targets because they have morals and a conscience.0 -

In certain areas of the country (highlighted in green)
all changes will be treated as requests to move to PIP from the 28th. So practically, in those areas you can't notify a change of DLA anymore, as the last day you could have done this was Friday.
A notification of a change of circumstances made before the relevant date in your area will lead to a form being posted out - and even if you complete that form and submit it after that date it will be treated under DLA rules. (assuming you return it in time).
For people in the rest of the country - the above still applies. If you are in reciept of DLA, and notify of a change, they will send out a form, and it will be dealt with under DLA rules.
This can change at any time, they do not need to pass any legislation whatsoever - simply post up a new map of areas the day before.
If your condition has worsened enough to qualify you for a higher rate of care or mobility, and you live outside the 'green' areas - you should consider reporting that change ASAP.
But being aware that if your award is marginal, this could also lead to a reduction.
Of course, if your condition has improved, more than any normal fluctuations, you have to tell them that too.0 -
Thank you so much roger, the form was sent out in September and I have had a couple of phone calls with them and they received the form back on the 25th October (rec del and signed for) so it will be dealt with by dla rules then? Oh and they are in the green area too.
I truly just don't understand these things and need reassurance sometimes as I'm trying to relay things back to others. So, the date the form was sent out, so long as it was sent back in a reasonable time is the date to go by really? Have I got that right? Thank you x0 -

Hi there Roger,
I called dla today and they confirmed that it would be classed as dla however they said as its high rate care and mob they can't higher the award which I knew and that is unlikely to lengthen it due to pip coming in.
Next question is, I know it could Infact be lowered which is unlikely but a possibility but care and mob have worsened. The advisor says that the application/form etc could be withdrawn if the person wants it to as unlikely to lengthen it.
Lots of medical evidence etc went with form but is it worth the risk and of course the long wait to find out?
Is it as easy as just phoning up and asking for the new form to be withdrawn?
I will wait to see what you advise.

Of course, the other thing is soooo much work went into filling the form in in the first place. Condition has worsened etc but do all decision makers work in the same way? X0
