Excel Parking 'Goodwill Gesture'

Hi guys, I'll try to keep this brief but any help/advise I can gather would be a great help.

I received a PCN from Excel Parking on 12/08/13 for an alleged contravention on 02/08/13. In short I did actually purchase a ticket but didn't enter my full registration 'A1 BCD' I only entered the first part 'A1'. I never noticed I was required to enter my full registration, and to be honest I've never seen a machine before with a full querty keypad to do so? It was dark and chucking it down with rain at the time, I just presumed if it took my money and gave me a ticket - job done.

Anyway, I sent a short email to appeal to Excel with a picture of the ticket and received a response on 18/09/13. The response was a 'goodwill gesture' that the charge will be reduced from the initial £100 to the administration fee of £10 if I pay before 02/10/13. No Popla code included in the letter.

So should I pay, ignore, or ask for a Popla code and go down that route?

I've already spent over an hour writing/reading letters and on one hand if I go down the Popla route I'll no doubt spend more time appealing. For the sake of £10 I can save myself a lot of stress, but on the other hand if everybody took that approach, Excel would be raking it in!

Maybe I should invoice them for my time, I am self employed and do charge per hour.

  • Obviously it's up to you and how much you value your own time BUT I'm always on the side of "give 'em a bashing". So, if it were me, I'd be rejecting their offer, appealing to them and requesting a POPLA code if they decide to reject the appeal.

    I guess the worst case scenario would be for me to get a Popla code and lose the appeal to Popla. How strong do you think my case is?

    Do you think it's worth giving Excel a call and asking them to close the case? Or is this unlikely to make any difference?

    I am of the mind that they don't deserve anything at all as you have paid. However is it worth the hassle for a tenner? Only you can decide that. But if for example you went to the cinema and paid to get in, would you be happy if they came around asking for more in the intermission (I'm old lol) asking for another tenner to see the end of the film, would you pay it ?
    When posting a parking issue on MSE do not reveal any information that may enable PPCs to identify you. They DO monitor the forum.
    We don't need the following to help you.
    Name, Address, PCN Number, Exact Date Of Incident, Date On Invoice, Reg Number, Vehicle Picture, The Time You Entered & Left Car Park, Or The Amount of Time You Overstayed.

    You have no case on mitigation. If you think about it, I can see you not entering any number at all, but I can't conceive why anyone would enter A1 knowing that this is as unique as an identical octuplet. You either knew you had to enter your car reg or you didn't. That would be the view a court would take, I contend.

    So, mitigation gone west.

    But you can win at POPLA using the current POPLA appeal points that you can see on the POPLA decisions sticky.

    Pragmatically, and only you can answer this - Did your actions actually cause the PPC any admin? If so, then is £10 really outrageous?

    Everyone wins at POPLA here - 100% success rate with forum-assisted appeals advised on for the whole of the last six months, against EVERY PPC!

    NEVER worth phoning a PPC. NEVER. Their agenda is not fairness nor parking management at all. It's money alone. Excel is owned by Simon Renshaw-Smith, a rich 'fat-cat' grinning ex-clamper (Google his name and the words 'Captain Clampit). You won't want to be phoning up his firm, pointless.

    And although it is ONLY a tenner, on principle if you were my relative I would tell you that this is not a firm worthy of being paid anything at all.

    Reply in writing or email and say 'no deal' and demand the POPLA code.

    By the way, if this was the Peel Centre do search the parking forum for the word 'Peel'. You would do best to read the other Peel or Excel threads and they are easy to find - there are DOZENS all current and all talking about appeals wording and POPLA. The other threads will help you see what happens when and how to word a winning POPLA appeal in these exact circumstances.

    There used to be ( and might still be ) a car park in Horley that asks for the first two characters of your reg to be inputted and nothing else.
  • In response to 'Guys Dad' - Thanks for the advice, but the only parking machines I've ever used (mainly council run) only require the numbers from your registration and I have a private plate with only 1 number. So it's conceivable why this occurred. But I have no experience of a court's view and your feedback is welcome.

  • Guilty or not the reduced charge is asked of everybody that appeals. That does scream of scam. Even someone with a valid ticket will get that £10 charge. So don't pay it and appeal to poppla (unless your in Scotland then just don't pay.

    Again even had a valid ticket and got the reduced fine of £15.
    finally tea total but in still in (more) debt (Oct 25 CC £1800, loan £6453, mortgage £59,924/158,000)

    OK but if you read the Peel threads anyway, by using the 'search this forum' facility on page one above the threads, and searching one keyword 'Peel' (and change the default search to 'SHOW POSTS') you will find this exact scenario covered from start to finish (winning wording in a POPLA appeal).
