Black Horse Finance PPI claim for 2000-2005

I took out car finance in 2000 to2005 with Black Horse Finance (Lloyds UDT at the time). Unfortunately I haven’t got the agreement.
I've sent them a SAR request usingthe template on this site which also included details such as previous addresses,DOB, the company I took the finance through and payment dates.
Their latest reply has stated thatif it more than three years then the agreement may have been removed from theirsystem and I would need an agreement number to enable them to locate it.
Is this a valid answer from them oris it a stalling tactics?
I’ve contacted my bank aboutgetting the direct debit details to see if this has the agreement number on butthey said that with the DD being so old I would have write to the archivedepartment.

Simply call them and ask.I did and got all my agreement numbers from 1997 through to 2005 and they even told if i had PPi and how much.If you don't ask you don't get.0

Thanks for you advice Cvsc. I had tried that and the cust. services rep said the same thing that my details may be archived and they could only search on an agreement number.0

I'd be interested to hear how you got on. I had a loan with Black Horse taken out in 2004 - I've just had my claim rejected on the grounds that the PPI was provided by a company called Cardif Pinnacle and that I should re-claim from them as they didn't provide the PPI until 2005...

Just got my rejection yesterday from Blackhorse. Took it out in 2003 in a garage, last customer late at night, no blackhorse or financial "advisor" just the car salesman.
It's on 3 pages and states that "it should be noted that as the sale was prior to 14th January 2005 the sale of PPI was not regulated by the FSA, however I have considered the appropriate regulatory requirements for the sale."
After covering a lot of stuff about eligibility, suitability and exclusions it summises that after completing their assessment and reviewing it both "singularly and holistically" ultimately they "believe" that the policy was suitable for me.
They are also "of the opinion" that the facts in the policy booklet and benefits and limitations were explained to me at the point of sale. NO, it was a garage at night ready for closing!
Conclusion: In light of the findings I "Feel" that our advisor acted fair and reasonably througout the sale.
At no time did I speak to an "advisor" other than the garage. And I had full sick pay if off work and able to refinance any failure to pay the loan from savings however no one explained this to me.
Is this a standard response by Blackhorse and should I fight it? They say I can't complain to FOS but I can to the Financial Leasing Association if I am still unhappy after reponsing?

In the letter you should have a date by which to reply by if you disagree with there decision,You can either call the number stated or write in to them detailing your reason why you disagree and they will have another 4 weeks to respond further. I they still don't uphold you may still be able to go to the FLA as stated in the letter.Hope this helps.

From my experience with Black Horse, I would say dont give up. We bought our 3 piece suite from SCS and the loan agreement was with Black Horse. It had PPI, my hubby tried to claim it twice when he was off work sick and they said no as they said it was a pre-existing condition, therefore totally useless to us in this situation.
We wrote to them to claim back the PPI and 3 times they wrote back saying that they couldn't find any agreement with us at all. We had no paperwork but had the account number from our bank statements. Every time they fobbed us off.
Then, a few weeks later, we were going through some old paperwork and found a loan agreement page for a loan they had tried to foist on us afterwards. We hadn't signed it but I wanted to double check that it hadnt been set up. When we phoned them about this they said "oh no, this was never taken out, but we do have an account number here for "Furniture"!! They gave us the number and we wrote back claiming the PPI again. Within 4 weeks we had a cheque for just over £400! Don't take ANYTHING that this company says for granted. If you are sure you were missold then dont give up.You're so very special, I wish I was special :dance:0 -
I sent a PPI claim letter to Black Horse recently for two car loans. I had the agreement numbers for each loan although I have no contract documentation.
I received a reply stating that they had reviewed my records and that I had not paid PPI on either loan, however they did not provide evidence to confirm this.
Should I send them a SAR letter ??0
