Flight Change

We've recently been contacted by Tui to say that our flight departure to Agadir (Dec 19th) has changed and instead of 09:00 it will now depart at 17:00.

Tui have said that we can cancel but we will not receive a refund as they don't deem 8hrs a "significant change".

however, as we will be arriving at the hotel at 22:00 instead of 14:00, I've tried to argue the following:

■ loss of 2x lunch and 2x dinner
■ loss of drinks (holiday is all inclusive)
■ loss of time in resort/sunshine first day
■ we've both booked an unnecessary extra day off work

all constitute a significant change to a short ONE_WEEK all inclusive holiday.

looking for any advice at all on how to proceed.

thanks

  • Can't you cancel the extra day off?

TUI, like all major operators who are members of ABTA consider 12 hours to be the point at which a change in flight time becomes a major change which would allow you to cancel. What has happened to the return journey as it would be usual for the flight, if operated by TUI itself, to be moved forward as well, so you get the missed meals on the last day instead of the first?
  • no. return flight hasn't changed.

does not 2x lunch and dinner, drinks, an afternoon in the resort and booking unnecessary time off work count as significant?

No, unfortunately for you. At best you might be offered discount vouchers for a future holiday.
  • to add insult to injury - Tui have just discounted the holiday.

    From £1956 (for 2)
it's now £1449 (for 2) with a further £100 off using an online code.

so they've just reduced the cost of the holiday by £600

As pointed out above, the Terms & Conditions of a TUI booking allow them to change flight times by up to 12 hours without considering it a major change.

You booked at a price you were happy to pay. Holiday prices are fluid and the same holiday can vary a lot based on a number of factors. Look at it the other way, if the holiday had increased in price, would you want to pay more?

This may not be what you want to hear but it is what it is. TUI are operating within their T&Cs. You could try again with them and see if you can get something as a gesture of good will. That is the best you can hope for, but TUI probably won’t make it easy.

If the flight departs at 17.00 hours you will have to be at the airport a couple of hours before take off time plus unless you live on the airport there will be travelling time to add on so you have not lost an unnecessary extra day off work have you?
  • well yes. we both work mornings only.
    our working day is 8am-1pm.
we live just 20 mins from airport, so we have wasted a days' leave each.

as the question in post 2 - can you cancel the leave day?
  • I will find out tomorrow - but it's unlikely as it would involve work schedules being changed around. fingers crossed though.
