    Lots of unanswered questions. If the OP thinks we are being tough critics he has a major wake up call ahead.

    Who made the current claim?
    Who acted on behalf of your father?
    How long has the house been in his name?
    Was it joint ownership or tenants in common?
    Why was the benefit used after the initial contact with DWP?

    Yes, there may have been systemic failings on the part of DWP to come back to you to stop the benefits, but you knew there was a major issue and so the benefits should have remained uncashed or annexed for safekeeping. There should be a lump sum waiting to be repaid.
