Help to deal with Lowell

My husband has 4 different debts that Lowell have now bought. Honestly we have just ignored them which I know us worse thing to do but we are barely getting by just paying normal bills never mind old debts. They have now threaten us with court action for one of the accounts ( which I don't understand why not all?) I have read that we should send a letter asking for proof that these are our debts is this true? Also they have spelt my husband's surname wrong on the letters. One of the debts is over 6 years old and we haven't paid anything towards the others in over 3yeara at least. Thank you for any advice.

    Hi,

    Send provit letter to all of them.

    See what comes back, do this now to avoid court action.

    If any then appear statute barred, the appropriate letter must again be sent.

    Hi do I send letter to Lowell to prove it or to the individual companies? Then what is the next step after I have sent that. Thank you

    Quote each individual ref number, then see what they come back to you with.

    Sourcrates.
    I have recieved a letter from Lowell saying that they have chosen one of the debts and if I do not contact by end of month they are taking legal action. What I have noticed is that there were 4 debts but one is away now. They haven't acknowledged the prove it letters that I have sent. What do i do? Do I phone to inform them of the letters that have been sent? They are still spelling our surname wrong too. TIA

    I wouldn't phone them.

    If they are going to try court action they must precede it with this

    and give you 30 days to reply. You can ask for the proof at that stage if it hasn't already come.

    How long is it since you last made a payment on the one they have chosen?

    The civil procedure rules were updated October 1st 2017, much more to the benefit of the debtor.

    Before court action can commence, the creditor MUST send you, what is known as a Letter Before Action, this basically sets out there case against you, its a questionnaire style form, and you can ask for the evidence then, as Fatbelly pointed out, they cannot refuse cooperation once this process has started.

    It is designed to resolve as many cases as possible without the need to continue to court.

    So, call there bluff, wait for the LBA, then proceed from there.

    You may have to fight each one on this basis, or you could just send a reminder letter to Lowell, they are a big organization with many different depts, confusion doth reign within them at times.

    I have found that email works well with Lowell.

    I don't know exactly but it's been at least 2years although not as much as 5 years. Should I just send another proof it letter to them? I have a note and photo of me posting the first letter to prove that I have sent them and not just pretending.

    Also I have never been given email address on any correspondence it has always been phone, post or via their website.
