    Should I email them all the proof it letters again? Thank you so much for all your help !!!55357;!!!56842;

    Just say you have already written asking for proof, and they have failed to respond to you.

    And that you would appreciate it if they would provide proof of liability for each account mentioned.

    They take ages to reply to a prove it letter, they took almost a month when I sent mine (and the response was incorrect as they had the years wrong). I wouldn't contact them unless you have to.
  • Sour crates Lowell have sent me out bills from 2 of the companies and a contract with no signature from the other company and saying they have sent out what was asked and to set up payment plan. What do I do now? Are bills/invoices proof?

    No, what sort of debt are these 3? Credit card? Mobile phone?
  • One is credit card one is mobile and one is Bt which I have disputed. What do I do know? Do I send a letter?

    Hopefully sourcrates will be here in a minute...

    You can continue to deny liability on the grounds that they have not provided proof but the two phone contracts would not have needed a signature.

    It may be worth posting a statement of affairs so that we can see whether repayment or insolvency would be his fallback position if Lowell took court action.

    Hi,

    You said in your initial post you had not made payment to one of the debts in more than 6 years, which debt would that be ?

    Proof for credit card account should be in the form of a credit agreement, the other two phone accounts would probably suffice with what they have sent you.

    Do you recognise the debts at all ?
    SOA is a good idea.

    My suggestion is to send Lowells a s77-79 CCA Request for the credit card debt including the £1 statutory fee. If they can’t comply with your request within the statutory timeframe the debt becomes unenforceable until or unless they do comply.

    Who was the original creditor for the credit card and could there have been PPI involved?

    Mobile phone accounts are service contracts so the s77-79 CCA wouldn’t apply to them unless this was O2 and the contract included a handset so there would have been a ‘split tarrif’ with the handset element provided as a regulated agreement separate from line rental. I think they began doing this in about 2014 and on all upgrades since.
