BW Legal - "LETTER OF CLAIM"

Afternoon all!

I will keep this as short and concise as possible.

In Aug 2017 I received a windscreen ticket in a private carpark at my home address for which I had a permit. I recall getting letters from Llawnroc Parking Services Ltd (the car park operator), MIL Collections and Debt Recovery Plus. Due to you know, life.. I can't recall the events of Aug 2017 in relation to any of this, only that yes, I did own the vehicle in question around that time!

I had assumed that all the mess was long done with but here we are. A letter from BW Legal popped through my letterbox today titled LETTER OF CLAIM. I have spent a fair few hours reading through this forum once again but the sheer amount of information you wonderful people have amassed is absolutely mind-boggling. So...

1. Is a Letter of Claim with with the A1 Information Sheet, Reply Form and 30 day deadline effectively the LBCCC/LBC/LBA?

2. I've read conflicting statements around the forum as to whether I should fill out the reply form or contact BW Legal directly via email.

3. I am currently on my phone, but am happy to upload my Letter of Claim this evening from my laptop if helpful.

I am a current serving member in the Armed Forces on compassionate leave to assist my pregnant wife in caring for my two children, one of whom has additional needs, in our recently purchased 'fixer-upper' first house. So as you can probably imagine stress levels are already fairly up the scale!

    Yes but you don't have to use those forms, there is no conflicting info; we never use them in case some numpty starts signing their life away with admissions or bank details.

    Safer to tell all posters never to use the forms.

    So, does your LBA prove to you their claim, photos, charges etc

    BWLegal add on a fake claim of £60 which is abuse of process

    As beamerguy stated, Llawnroc are with the IPC. I cant find any information to suggest that they are banned for accessing DVLA information or that they've since ceased 'trading'.

    Okay so more than likely going to court, happy. Don't use the reply forms, hit them up via email instead, happy.
    So, does your LBA prove to you their claim, photos, charges etc

    I will upload the letter once the kids are in bed (hopefully an hour or so!) No photos, no evidence and they haven't broken down my invoice, just a straight £140 owed.

    Nine times out of ten these tickets are scams so consider complaining to your MP.

    Parliament is well aware of the MO of these private parking companies, many of whom are former clampers, and on 15th March 2019 a Bill was enacted to curb the excesses of these shysters. Codes of Practice are being drawn up, an independent appeals service will be set up, and access to the DVLA's date base more rigorously policed, persistent offenders denied access to the DVLA database and unable to operate.

    Hopefully life will become impossible for the worst of these scammers, but until this is done you should still complain to your MP, citing the new legislation.

    Just as the clampers were finally closed down, so hopefully will many of these Private Parking Companies
    You never know how far you can go until you go too far.
  • I can't really add much more to the above, but I would suggest sending a Subject Access Request to the PPC, MIL, Debt Recovery Plus and the DVLA. If they are going to turn litigious, it's handy to have all of that information to hand before they get going.

    Apologies for not getting this up last night! I will have another look through the stickies regarding SAR's. Am I correct in thinking that my first course of action is to email BW Legal requesting any information and evidence they hold against me, clearly stating that I was the registered keeper at the time, not mentioning anything about being or not being the driver.

    Llawnroc could have sold your debt to Mil Collections.


    Mil Collections have stopped taking people to court recently, therefore they may have sold the debt back to Llawnroc. This possibly has Data breach implications.

    I've had several private parking tickets in the last few years and while I've followed this forums advice to the best of my ability fortunately most of them have simply disappeared - for now. Unfortunately however, years later, I am unable to remember which tickets went to DRP/MIL and which didn't. I am sitting down this afternoon with the intention of getting as much of this squared away as possible.
    I can't really add much more to the above, but I would suggest sending a Subject Access Request to the PPC, MIL, Debt Recovery Plus and the DVLA.

    I will have yet another read up about SAR this afternoon and send out some emails. I'm assuming that a SAR is a legal request and that the company receiving the SAR would have to comply, is this correct? If so, in asking for any information relating to XXXX XXX vehicle and my name as the registered keeper (not the driver) that would have to comply.

    Was this alleged debt sold or purportedly assigned to a third party such as MIL Collections, if so please include all paperwork and internal notes, checks and data sharing records relating to that alleged assignment and all data relating to the re-assignment back to your company.

    In your SAR to the PPC, include this question

    Thanks for your continuing support! I have sent off a SAR to Llawnroc and a further email to BW Legal exercising my right to restrict them processing my data and asking for a 'hold' as per the sticky. I did include a request similar to your posted question but also added in DRP and any company or person external to Llawnroc.

    Would you/anyone benefit from me posting an image of the PDF's sent to Llawnroc and BW Legal or shall I leave it? I don't want to clutter the forum with links to unnecessary documents. As someone new to all of this legal stuff I feel your stickies and advise on previous threads is well structured and concise! So honestly, thank you all!

    EDIT: In relation to invoice breakdown posted above (#7), my £140 charge consists of 'Principle Balance + Initial Legal Costs: £140. Am I right to assume that 'initial legal costs' are considered the abuse of process as they haven't in fact incurred any initial legal costs. TIA
